AFFIDAVIT. In the Supreme Court of Newfoundland. NEWFOUNDLAND, } So help me God. Sworn before me at St. John's }
1894 Estate of John R. Kearney Probate granted to Dated 30th May 1894 Estate sworn under $2000.00
In the Supreme Court of Newfoundland. NEWFOUNDLAND, } I Frank D. Lilly of St Johns aforesaid Barrister at Law make oath and say that on the Sixth day of March A.D., One Thousand Eight Hundred and Ninety-three at St Johns aforesaid I was present and did see John R. Kearney late of St Johns aforesaid Landing and Tide Surveyor in Her Majestys Customs Department the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence, and in the presence of Lizzie O'Dwyer the other subscribing witness thereto. That I and said Lizzie O'Dwyer then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief. Notice Three days from the date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate to the last Will and Testament of John R. Kearney late of St. Johns Landing and Tide Surveyor in Her Majestys Customs Department deceased to be granted to Mary F. Kearney the Executrix named in said Will
This is to certify that the notice on the other side hereof written has been posted in the office of the Chief Clerk and Registrar of the Supreme Court from the date of the date thereof until this date and that no caveat or other objection has been filed thereto St. Johns May 29th 1894
This is the last Will and Testament of me John R. Kearney of Saint Johns in the Island of Newfoundland Landing and Tide Surveyor in Her Majestys Customs Department I give devise and bequeath all the real and personal Estate to which I shall be entitled at the time of my decease unto my beloved wife Mary F. Kearney absolutely and I appoint her the sole Executrix of this my Will hereby revoking all former testamentary writings. Signed by the above named }
Will of
To the Honorable the Supreme Court or to one of the Honorable the Judges thereof Humbly Sheweth That John R. Kearney late of St Johns Landing and Tide Surveyor in Her Majestys Customs Department died at that place on or about the third day of March last past having first Executed the paper writing hereto annexed as and for his last Will and Testament and therein appointed your Petitioner Executrix thereof. The said deceased at the time of his death was possessed of property of the probable value of two thousand dollars. That no Probate to the Will or Administration to the Estate and Effects of the said deceased has been at any time granted. Your Petitioner therefore prays that this Honorable Court will be pleased to grant to her Probate to the Will of the said John R. Kearney This is page two of the above. Kearney.
