In the Supreme Court of Newfoundland

NEWFOUNDLAND,  }
Fortune Bay                  } I, Patrick Hartigan of Rencontre in
Harbor Breton To Wit: } Fortune Bay in the Southern District of Newfoundland, Planter ---------------- do swear that I believe that Johanna Hartigan late of Rencontre aforesaid married woman ------------- deceased died without---- a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay her Debts so far as her Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Three hundred ----------------------- Dollars.

So help me GOD.

  2. That in the matter of application for ad-ministration to the Estate of the said Johanna Hartigan the said firm have adj? as solicitors for the petitioner Patrick Hartigan
  3. That the said Patrick Hartigan is the said petitioner named was as I am informed and verily believe the husband of the said Johanna Hartigan.
  4. That the moneys of the said deceased are on deposit receipt in the Commercial Bank of Newfoundland in her own name.

The Petition of Patrick Hartigan of Rencontre Fortune Bay Planter

Humbly Sheweth

  1. That Johanna Hartigan of Rencontre aforesaid wife of your petitioner died there on or about The dec 3rd day of February last past without having made a will
  2. That the said intestate died possessed of property within the Jurisdiction of this honorable Court to the probable value of $25000
  3. That she left her surviving your petitioner and five children consisting of three (word partially smudged) sons and two daughters
  4. That no letters of Administration to her said Estate have heretofore been granted to any one

          Petitioner therefore prays that letter of admin-istration to the said Estate of Johanna Hartigan may be granted forth of this honorable Court to have and as in duty bound he will ever pray &c &c

                    Be it Remembered,
That on this second day of October in the Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and ninety four personally appeared St Johns Instructor? James J. Norris of and John I. Coleman of St. John's Carpenter and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Five Hundred dollars ------------------- to be had, made, and levied on their Goods, Chat-tels, and effects jointly and severally if default is made in any of the Conditions following:---

          Now the Condition of this Obligation is such, that if the above bounden Patrick Hartigan of Rencontre Fortune Bay Southern District Planter ----------------------------------- as Administrator ------------------------------------------------ of the Estate and Effects of Johannah Hartigan late of Rencontre aforesaid Married Woman deceased, do make, or cause to be made, a just, true and perfect Inven-tory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Patrick Hartigan --- as such Administrator --------------------------------- or to the hands or possession of any person or persons, for him and the same so made do exhibit, or cause to be exhibited into the Supreme Court of Newfoundland, at or before the second day of April next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all the other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come to the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly admin-ister according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the Second day of October which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Admin-istration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect or else to be and remain in full force and virtue.
