Nicholas Galway Estate of Nicholas Galway 1894
AFFIDAVIT. In the Supreme Court of Newfoundland. NEWFOUNDLAND, } I do swear that I believe this to be the true Last Will and Testament of Nicholas Galway late of Saint John's in the Central District Cooper deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Nicholas Galway, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two Thousand dollars So help me God. Certificate I do hereby certify that the notice on the other side hereof written has been posted in the office of the Chief Clerk and Registrar for three days from the date thereof and that no caveat or other objection has been filed or entered thereto.
Notice Three days from date hereof application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for probate to the last will and testament of Nicholas Galway late of Saint John's Coope deceased to be granted to Michael Galway the son of said deceased and sole executor named in said will.
To the Honorable the The petition of Michael Galway of St. John's in the island of Newfoundland Cooper Humbly Sheweth That Nicholas Galway formerly of Saint John's Cooper died there on or about the fourth day of July Anno Domini one thousand eight hundred and ninety three having first made his last will and testament, hereto annexed proven in common form upon the oath of John W. White a solicitor of the Supreme Court one of the sub-scribing witnesses thereto. That in and by his said last will and testament the said Testator nominated and appointed your petitioner his executor That at the time of his death the said testator was possessed of property of the probable value of two thousand dollars That Page 2 of above page That no probate to any will nor letters of administration to any estate has as yet been granted to any person Petitioner therefore prays that probate to the said will may be granted to him as executor aforesaid and as in duty bound will ever pray &c Michael I Galway
