AFFIDAVIT.

In the Supreme Court of Newfoundland

NEWFOUNDLAND } I, The Very Reverend John Scott of
St. John's To Wit:       } St. John's in the Central District Roman Catholic Priest------------ do swear that I believe that Martin Furlong late of St. John's, aforesaid, Tidewaiter -------------- deceased died with----------- a Will; and that I will well and truly administer all and every the Goods of the said deceased which have not been administered (Initialled in left margin GIA) and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased of which he died possessed, within the jurisdiction of this Court and which are now unadministered (Initialled in left margin GIA) do not according to the best of him knowledge, judgment and belief, amount to the value of two thousand ---------------Dollars.

This is to certify that the notice written on the Face thereof has been duly posted in the office of the Chief Clerk & Registrar for the space of three days as required by Statute
          St. Johns September 3rd 1894

 

 

After three days from the date hereof application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for the grant of Letters of administration cum testament annexo de bonis non of the Estate and Effects which were of Martin Furlong formerly of St. Johns Tide-waiter deceased to be issued to the Very Reverend John Scott of St. Johns aforesaid Roman Catholic Priest.

          I do hereby on behalf of the Benevalent Irish Society legatees and the third class of the will of the said testator agree that administration with the will annexed de bonis non be granted to the Very Reverend John Scott Roman Catholic Priest.

The Petition of the Very Reverend John Scott of St. Johns Roman Catholic Priest

Humbly Sheweth

  1. That Martin Furlong formerly of St Johns a Tidewaiter in Her Majesty's Customs died at that place on or about the Eight day of April 1884 having made and executed his last will and testament of which he appointed his wife Margaret as executrix and therein bequeathed to her a life interest in all he died possessed of. All of which is more specifically set forth in the Copy of the said will hereto annexed and in the petition for which of the said Margaret dated the _ 24th - date of May - A.D. 1884.
  2. That after the decease of his said wife Margaret that said testator in and by the third clause in his said will contained bequeathed all his property estate and effects to the Benevolent Irish Society of St. Johns and to the Bishop of St Johns as Trustee for the Roman Catholic Orphanage at Belvidere in equal proportions
  3. That on or about the            day of August just past the said Margaret Furlong died at St. Johns intestate & without appointing anyone to continue the administration of the Estate of the Said Martin Furlong.
  4. That at the time of the death of the said Margaret

    Furlong the Estate of the said Testator con-sisted of to the best of petitioners knowledge and so far as he can ascertain three tenement houses on North side of Duckworth and a piece of ground rented at Twenty four dollars per annum making in all a total value of about $200000.
  5. That the only next of kin who survived the said Martin Furlong besides his said wife was one sister Mrs. Charles Power widow who is still living.
  6. That since the death of the said Margaret Furlong your petitioner is informed and verily believes that no administrator or other representative has been appointed to the Estate of the said deceased Martin Furlong.
  7. Your petitioner therefore humbly prays that as representing the legatees in the said will of the said Martin Furlong named he may be appointed Administrator cum testament annexo de bonis non which were of the said testator & that letters of administration to that effect be issued forth of this honorable Court & as in duty bound he will ever pray &c. &c.
