In the Supreme Court of Newfoundland

NEWFOUNDLAND, } I, George Hall of St. John's in
St. John's To Wit:        } the Central District, Mercantile Agent

do swear that I believe that John E. Florance late of Battle Harbor, Labrador, Mercantile Agent.
------------------------------------------------------- deceased died with -----------a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of two thousand five hundred Dollars.

So help me GOD.

Florance of Battle Harbour - Labrador, Mercantile Agent, deceased, to be granted to George Hall of Battle Harbour & St. John's, Mercantile Agent, a legatee under the will of the said deceased.

Greeting:

I, reposing especial confidence in your integrity and ability do, by virtue of the power and authority in me vested, hereby constitute and appoint you a Commissioner for issuing Mesne Process,returnable into the Supreme Court of Newfoundland, and (initialled left margin AJWMcN) for taking and receiving all such Affidavits as any persons shall be required or willing to make in or concerning any in certain (initialled AJWMcN both sides of the insert) matter of thing depending or hereafter to be instituted (initalled AJWMcN, right margin) in the said Court, and when and so often as need shall be to administer an Oath or Oaths to any of such persons, or to the Sheriff or his Deputy or Bailiff, in all those (initalled AJWMcN above deleted sentence) cases where by law in the said Court an Affidavit is required to be made. (initalled AJWMcN in left margin) this Commission being limited to affidavits in proof of the will of one John E. Florance late of Battle Harbour aforesaid, Accountant.

make oath and say that on the fourth day of December A.D., One Thousand Eight Hundred and Ninety-two at Battle Harbour aforesaid I was present and did see John E. Florance late of Battle Harbour aforesaid Mercantile Agent the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence and in the presence of George Bradbury of Battle Harbour aforesaid Fisherman the other subscribing witness thereto. That I and said George Bradbury then and there signed our names to such Will as such witnesses the latter by affixing his mark thereto (initialled front and back by E.L.) in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

The Petition of George Hall of Saint John's in the Island
of Newfoundland, Mercantile Agent,

Humbly Sheweth

  1. That
  2. John E. Florance late of Battle Harbour on Labrador, Mercantile Agent, died on or about the twenty sixth day of January and last past, having first made and published his last will and testament, which is hereunto annexed.
  3. That the only next of kin of the said John E. Florance are his brother and sister Albert Florance and Isabella Florance who reside without the jurisdiction of this Honourable Court, namely at Wareham in the County of Dorset in England.
  4. That the said Albert Florance and Isabella Florance have consented that Letters of Administration with the will annexed to the Estate and Effects of the said John E. Florance in Newfoundland be granted to your Petitioner and that here to annexed is their written consent.
  5. That the Estate and Effects of the said John E. Florance that are within the jurisdiction of this Honourable Court do not exceed in value Two Thousand Four Hundred and Fifty Dollars.
    That Your Petitioner is one of the principal and residual (?) legatees under the will of the said John E. Florance.
  6. That no probate to any will or letters of administration to the Estate of

of the said John E. Florance have been granted or applied for.
          Your Petitioner therefore prays that Letters of Administration to the Estate and Effects of the said John E. Florance with the will annexed be granted to him.
          And, as in duty bound, Your Petitioner will ever pray so.

Be it Remembered, That on this fourth day of January----- in the fifty seventh Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, QUEEN, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety-four, personally appeared George Hall of St. John's in the Central District, Mercantile Agent, John C. Hepburn of St. John's Accountant and Archibald Lindsay of St. John's Accountant ---------------------- and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Five thousand dollars --------------- to be had, made, and levied on their Goods, Chattels, and Effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition Of this Obligation is such, that if the above bounden George Hall------------- as Administrator of the Estate and Effects of John E. Florance Florance/GIA (first writing of surname written over and not totally legible), late of Battle Harbor, Labrador, Mercantile Agent deceased, do make, or cause to be made, a just, true and perfect Inventory of all the singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said George Hall ----------- as such Administrator or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the fourth day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of him the said George Hall -------- or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 4th day of January, which will be in the year of Our Lord One Thousand Eight Hundred and Ninety five and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect, or else to be and remain in full force and virtue.
