AFFIDAVIT. NEWFOUNDLAND, } I, Henry B. Dryer of St. John's deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay her Debts so far as her Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of one thousand --------------------Dollars. In the matter of the Estate We the undersigned children of Eliza Parsons and nephews and nieces of the above named Rebecca Flood hereby consent to Henry B Dryer Clerk in the General Post Office obtaining administration to the above Estate
To the Honorable the Supreme Court or one of the Honorable Judges thereof The petition of Henry B. Dryer of Saint Johns Clerk in the General Post Office Humbly Sheweth That petitioners aunt Rebecca Flood late of Saint Johns spinster deceased died at that place on or about the thirteenth day of September One Thousand eight hundred and seventy three That at the time of her death she left her surviving her brother John Flood now residing in England her sister Mary Ann Dryer since deceased Juliana Flood spinster since deceased Sarah Flood at present of Placentia Newfoundland and John R. Parsons Robert John Parsons Charles F Parsons Elivra, Mary Ann, Emma, and Willeminah Parsons children of Elvira Parsons sister of the said late Rebecca Flood who predeceased her That the said Mary Ann Dryer left her surviving your Petitioner who is administrator of her Estate and effects and her other children are consenting parties to his obtaining administration That hereto annexed is the consent in writing of the children of the said Elvira Parsons excepting Elvira and John who are residing in the United States of America to petitioner obtaining administration to the said Estate That the said Sarah Flood is a nun in the Convent of Placentia This is page two (2) of the above page (Note: the following added at top of page:) That the said Rebecca Flood died That no probate or administration has been granted to her Estate Petitioner therefore prays that Letters of administration to the Estate and effects of the said Rebecca Flood may be granted to him And as in duty bound he will ever pray. Supreme Court of Newfoundland Be it Remembered, That on this day of March in the 57th Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, QUEEN, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety four personally appeared Henry B. Dryer of St. John's in the Central District Superintendent Money Order Office Michael K. Greene of St. Johns, auctioneer and William G. Dryer of St. John's, Clerk and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Two thousand dollars ---------- to be had, made, and levied on their Goods, Chattels, and Effects jointly and severally if default is made in any of the Conditions following:--- Now the Condition Of this Obligation is such, that if the above bounden Henry B. Dryer ----- as Administrator of the Estate and Effects of Rebecca Flood late of St. John's, aforesaid, Spinster deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Henry B. Dryer as such Administrator or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland at or before the day of September next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and of other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come to the hands or possession of him the said Henry B. Dryer or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the day of March which will be in the year of Our Lord One Thousand Eight Hundred and Ninety five and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Adminis-tration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect, or else to be and remain in full force and virtue.
