NEWFOUNDLAND,  }I, Margaret Dunn of
St. John's To Wit          } St. John's Spinster-------------
do swear that I believe that Alice Dunn late of St. John's aforesaid, widow --------------------------

deceased died with------------------a will; and that I will well and truly administer all and every the Goods of the said deceased, and pay her Debts so far as her Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of nine hundred and fifty ---------------- Dollars.
So help me GOD.

make oath and say that on the twenty second day of February A.D., One Thousand Eight Hundred and Ninety-four at St. John's aforesaid I was present and did see Alice Dunn late of St. John's aforesaid the Testatrix named in the paper writing hereunto annexed, marked A, duly sign, (by making her mark) publish and declare the said annexed paper writing, as and for her last Will and Testament in my presence, and in the presence of James McFarlane the other subscribing witness thereto. That I and said James McFarlane then and there signed our names to such Will as such witnesses, in the presence of said Testatrix and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by, the said Testatrix in the presence of me and the said James McFarlane and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

Be it remembered, that on this Ninth day of May ---- in the Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Ninety-four personally appeared
Margaret Dunn of St. John's in the Central District, Spinster.
Patrick Hickey of same place Grocer and
James Fitzhenry of same place, Cooper
and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Nineteen hundred dollars
To be had, made, and levied on their Goods, Chattels, and Effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition Of this Obligation is such, that if the above bounden Margaret Dunn as Administratrix Cum Testamento annexo-------------------- of the Estate and Effects of Alice Dunn ------------- late of St. John's, aforesaid, widow -------------------- deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits and Effects of the said deceased which have or shall come to the hands, possession, or knowledge of her the said Margaret Dunn as such Administratrix or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the Ninth day of September next ensuing the date hereof; and the said Goods, Chattels, Credit and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased; at the time of her death, or which at any time afterwards shall come to the hands or possession of her the said Administratrix or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the Ninth day of May which will be in the year of Our Lord One Thousand Eight Hundred and Ninety-five and afterwards from time to time as she shall be lawfully required. And, all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect, or else to be and remain in full force and virtue.

This is the last Will and Testament of me Alice Dunn of St. John's Widow I will devise and bequeath to my daughters Mary Gladney wife of Patrick Gladney and Margaret Dunn all the property of every description which I may be possessed of to be equally divided between them. I appoint James O'Neil of St. John's Executor of this my will.

To the Honorable the Supreme Court of Newfoundland or to one of the Honourable the Judges thereof.

The petition of Margaret Dunn of Saint Johns Spinster.

Humbly Sheweth as follows:-

  1. Alice Dunn late of St. John's in the Central District deceased died at said place on or about the 18th day of April AD 1894 having previously made and executed her last will and testament which is hereto annexed marked A and proved in common form by Michael P. Gibbs one of the subscribing witnesses thereto.
  2. The said deceased left her surviving your petitioner and Mary Gladney (wife of Patrick Gladney) daughters of said deceased and four grandchildren, children of her daughter Catherine Mulchay wife of James Mulchay who died during her lifetime.
  3. The executor appointed under said will has duly renounced all claims and rights thereto as will appear by his affidavit which is hereto annexed marked B.
  4. The said deceased at the time of her death was possessed of property of the


    probate value of nine hundred dollars
  5. That no probate or Letters of Administration to the Estate of said deceased have been previously applied for and that Mary Gladney has consented to Letters of administration ??? has ??????? annex, being granted to me.

Your petitioner therefore prays that Letters of Administration cum testamento annexo may be granted to her and as in duty bound she will ever pray &c.
