In the Supreme Court of Newfoundland

NEWFOUNDLAND,          }
St. John's to Wit:                 } I, John Daly of Ragged Harbor Trinity Bay Planter do swear that I believe that Simon Daly late of Ragged Harbor, aforesaid, fisherman

Deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed and which are now unadministered within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of three hundred and eighty -------- Dollars.
So help me God

TO (John crossed out, signature above illegible) Ann Daley of Ragged Harbor, Trinity Bay, Widow (word, possibly husband, crossed out and initialed, possibly Ba).

Wheras Simon Daley, late of Ragged Harbor, Fisherman
Deceased (as is alleged) lately died intestate -------------------------------------------------------
Having whilst living, and at the time of -------------- his death, divers goods, chattels, credits and effects, within the said Island of Newfoundland and within the jurisdiction of the Supreme Court

by reason whereof, the sole ordering and granting Administration of all and singular the said Goods, chattels, credits and effects, and also the auditing, allowing, and finally discharging the account thereof, are well known to appertain wholly to the said Supreme Court: and, we, being desirous that the said goods, chattels, credits and effects, may be well and faithfully administered applied and disposed of, according to law, do therefore by these presents, having confidence in your fidelity and integrity, nominate, order and appoint you, the said --------------- (John crossed out, initialed by GJA) Ann (GJA) Daley, Administratrix of all and singular the goods, chattels, credits and effects of the said deceased, within the said Island of Newfoundland and its Dependencies, and do hereby grant you full power and authority to demand, sue for, recover and receive the same, in whosoever hands or custody they remain, and fully and freely to administer and dispose of the same according to law; you, being first duly sworn that you will well and truly administer all and every the goods of the said deceased, and pay his debts so far as his goods will extend and the law requires; and that you will exhibit a true, full and perfect Inventory of the said goods of the said deceased, and render a true account of your Administration into the Registry of the Supreme Court, within six months from the date hereof, or when you shall be thereunto lawfully required; and being also further sworn that the whole of the goods, right, chattels, assets, credits and effects of the said deceased, within the jurisdiction of the Supreme Court, do not according to the best of your knowledge, judgment and belief, amount to the value of four hundred --------------- Dollars.

In testimony whereof I have hereunto subscribed my hand and affixed the Seal of the Supreme Court this 30th day of May A.D. 1893, in the Fifty-Sixth year of Her Majesty's Reign.

          To the Honourable the Supreme Court or to one of the Honourable the Judges thereof

          The Petition of John Daly of Ragged Harbour in Trinity Bay, Planter

          Respectfully sheweth as follows:

  1. Ann Daly late of Ragged Harbour aforesaid widow died there on the 5th day of January last intestate.

  2. On the 30th day of May AD 1893 the said Ann Daly was appointed Administratrix of the Estate of Simon Daly late of Ragged Harbour Fisherman deceased as will appear by reference to the Letters of Administration hereto annexed.

  3. The Estate of the said Simon Daly was not fully administered by the said Ann Daly and there still remains to be administered a sum of Three hundred and Twenty Six Dollars, deposited in the Union Bank of Newfoundland, in the name of the said Ann Daly as Administratrix.

  4. There are now living the following children of said Simon Daly namely (1) Michael (2) Simon (3) Richard (4) Teresa and (5) John all residing at Ragged Harbour aforesaid.

  5. 5 annexed.

  6. Annexed hereto is an informal consent signed by the said children to the settlement of all matters pertaining to the Estate of said deceased by petitioner.

  7. Petitioner is a brother of the said Simon Daly deceased.

          Petitioner therefore prays that Administration of such part of the Estate of said Simon Daly deceased as has not been administered may be granted to him.

          Dated at Saint John's this 25th day of May A.D. 1894

Be it Remembered,
That on this 28th day of May in the 57th Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland; Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and ninety four personally appeared John Daly of Ragged Harbor, Trinity Bay Planter, James Murphy of Catalina Fisherman and Edward Murphy of Catalina fisherman --------------- and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Seven hundred & sixty dollars to be had, made, and levied on their Goods, Chattels, and effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition Of this Obligation is such, that if the above bounden John Daly----------------- as Administrator -------------------------------------- of the Estate and Effects of Simon Daly -------- late of Ragged Harbor fisherman deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Daly --------- as such Administrator --------------------------- or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited, unto the Supreme Court of Newfoundland, at or before the 28th day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of him the said John Daly ------------------------- or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 28th day of May which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct; --- then this Obligation to be void and of no effect or else to be and remain in full force and virtue.
