AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of Mary Ann Jackman, late of St. John's in the Island of Newfoundland, widow, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Mary Ann Jackman, deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Two Thousand Five Hundred Dollars.

So help you God.

of their Lordships the Judges thereof.

The Petition of Lionel T. Chancey and Colin Campbell of Saint John's in the Island of Newfoundland.

Humbly Sheweth

That Mary Ann Jackson, late of Saint John's aforesaid, Widow, died at this place on the sixteenth day of July instant being possessed at the time of her death of property within the jurisdiction of this Honourable Court to the probable value of about two thousand dollars.
That hereunto annexed is the Last Will and Testament of the said Mary Ann Jackson under which your Petitioners have been appointed Executors.
That no application for Probate or for Administration to the Estate of the said deceased has heretofore been made to this Honourable Court.
Your Petitioners therefore pray that Your Honourable Court, or one of Your Lordships the Judges thereof, will be pleased to grant unto them Probate to the said Will
And as in duty bound Your Petitioners will ever pray.
At Saint John's this twenty third day of July A.D. One Thousand eight hundred and eighty nine.

This is the last Will and Testament of me, Mary Anne Jackman of Saint John's in the Island of Newfoundland.

In the name of Him who has always proved the widows friend, I give and bequeath to the Trustees of Congregational Church in Saint John's as a thank offering for God's providential care over my widowhood for many long and lonely years and for the furtherance of the Gospel of Christ the sum of One Hundred and Fifty Pounds currency now held by the said Trustees on loan from me or such portion of that sum as may be held by them at my death.
And further I direct and desire that my interest in the fee simple Brick House on Water Street at present held under lease by Miss Margaret Blake be sold - provided the said house is not sold before my decease, and the net proceeds of such sale of said House be disposed of as I shall now direct. I give devise and bequeath to my nephew John Fry Ward Hanley the sum of One Hundred Pounds currrency and should the said John Fry Ward Hanley not appear and claim this bequest then the said sum of One Hundred Pounds to be deposited by Executors hereinafter named in the Savings Bank of Newfoundland, there to remain at interest for a period of Five Years from the First day of January One Thousand Eight Hundred and Eighty Seven and in the event of his not appearing to claim said bequest on or before the expiration of the time above specified

then it is my will and desire that the said bequest of One Hundred Pounds be transferred or given to Congregational Missions to remain at interest----and that the interest of the said one hundred pounds be given yearly as a bequest to Congregational Missions in Newfoundland during the five years above referred to.
I also give and bequeath to the daughters of Mrs. Eunice Heigh and my great Niece Janie Fry the balance of the net proceeds of the sale of said house, share and share alike and should the said house be sold before my decease then the balance invested or in my possession to be divided amongst them, share and share alike.
I also direct and desire that the other minor matters of my Estate be disposed of as Mrs. William Campbell and Mrs. Ebeneazer Barnes may be advised and instructed by me in writing or otherwise.
And for the purpose of carring out the provisions of this Will, I appoint Lionel T. Chancey and Colin Campbell, both of Saint John's aforesaid, my Executors.
And lastly I annul and order to be destroyed a former will made by me and dated October 27th Anno Domini One Thousand Eight Hundred and Eighty Two.

TO WIT          } Robert Barnes of Saint John's aforesaid, Merchant, maketh oath and saith that on the twenty fifth day of October A.D. one thousand eight hundred and eighty six at Saint John's aforesaid he this deponent was present and did see Mary Anne Jackman late of Saint John's aforesaid, Widow, the Testatrix named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for her last Will and Testament in the presence of this Deponent and of Edward Thomas of this place,Carpenter, the other subscribing witness thereto. That Deponent and said Edward Thomas then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Upon reading the Peititon of Lionel T. Chancey and Colin Campbell, the Executors of the Will of the said Mary Anne Jackman and the affidavit of Lionel T. Chancey thereto annexed and upon hearing Wm. Horwood of Counsel for the said Executors I do order that the Executors do appear to prove the said will in solemn Form before me at Chambers on Wednesday the 27th instant at twelve o'clock noon, November 14th 1889.

The Petition of Lionel T. Chancey and Colin Campbell, the Executors of the Will of the late Mary Anne Jackman, formerly of Saint John's in the island of Newfoundland, widow.

Humbly Sheweth

That Your Petitioners were appointed as Executors under the last Will and Testament of the said Mary Anne Jackman, deceased, and that the said Will has since been proven in ordinary form in this Honourable Court and Probate granted to Your Petitioners.
That on the fifth day of November instant a citation directed to Your Petitioners was issued at the instance of Eunice A. Weigh, Susan T. Howe, William H. Fry and Janie Griggs, all of Madison in the State of Indiana in the United States of America to compel the said Will of the said Mary Anne Jackman being proven in solemn form in this Honourable Court.
Your Petitioners therefore humbly pray that Your Honourable Court or one of Your Lordships the Judges thereof may order and direct that the said will may be proven in solemn form and appoint a time and place for that purpose.
And as in duty bound Your Petitioners will ever pray.
At Saint John's aforesaid this fourteenth day of November A.D. 1889.
