AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of George Humphries late of Catalina in the Northern District of the Island of Newfoundland, Planter, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said George Humphries, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Five Hundred Dollars.

So help you God.

The Petition of Patrick Murphy of Catalina in the Northern District of Newfoundland

Humbly Sheweth

George Humphries, late of Catalina aforesaid, died on or about the seventh day of March last (1889) having first made his last will and testament which is hereunto annexed, proved upon the oath of John Murphy, one of the subscribing witnesses thereto.
That under and by virtue of the said will your Petitioner is appointed executor thereof.
That the Testator at the time of his death had a fixed place of abode within the jurisdiction of your Honorable Court, namely at Catalina aforesaid and was possessed of property at the time of his death of the probable value of Four Hundred Dollars.
That neither probate of the annexed or any will nor administration to his Estate has

been granted to any one.
Your Petitioner therefore prays that probate of the said last will and testament as executor thereof be granted to him and as in duty bound he will ever pray.
Dated at Bonavista in the Northern District of Newfoundland this twenty seventh day of September A.D. 1889.

TO WIT                    SUPREME COURT OF NEWFOUNDLAND

John Murphy of Catalina, Newfoundland, Fisherman, maketh oath and saith that on the 10th day of February A.D. one thousand eight hundred and eighty nine at Catalina he this deponent was present and did see George Humphries late of Catalina, Planter, the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of George Humphries the other subscribing witness thereto. That Deponent and said George Humphries then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

In the Name of God, Amen.

I George Humphries of Catalina in the District of Trinity East, being in poor health but of sound mind and memory do now make my last will and Testament.

I will and bequeath to my Son James Humphries the grounds that he now occupies on the right hand side of the Main road facing North East, also a piece of clear lands in the potatoe garden that he now occupies this year, for Ever.

I will and bequeath to my son John Humphries a piece of clear land in the potatoe garden facing the piece that James occupies in the lower range? the piece is the same size as James occupies in the potatoe gardens for Ever.

I will and bequeath to my two sons, William & Edward Humphries all the rest of my land property, both of these sons to have and equal shares, each for Ever.

I will and bequeath to my sons James Humphries, William Humphries & Edward Humphries all my ?????????? property and to have it equally divided among them after my death they are to have the property for Ever.

I will and bequeath to my son Edward Humphries my dwelling house for ever after William gets a home of his own but William is to live in the house and have the same control as Edward whilst living there but Edward is the lawful owner of the house after William goes to live in his own house. Also Edward is to have all the furniture that is in the dwelling house.

The aforesaid is conditionally that the above mentioned parties is to keep up the home and fences and none of my children is to take charge of anything that is on the rooms or property until my decease and no part of my property that is bequeathed to my sons is ever to go out of the family. No person is to have any claim on my property without it is sons Humphries. If any of my sons should ever think of selling their part of the property it is to be sold to one of their brothers or any of them. The property is never to go out of the Humphries name.

My three sons, James Humphries, William Humphries and Edward Humphries is to assist one another to keep the fishing rooms in repair.

the same will have no claim of the above lands, their portions will be merged in the other lots none of my daughters is to have any claim on my property after my decease.

Signed by George Humphries, Testator, in our presence and then in his presence and in the presence of each other, subscribe our names to witness.

I also appoint Patrick Murphy to be executor of my Last Will and Testament.

This will not be read until thirty days after my death.

Dated at Catalina February 10th in the year of our Lord one thousand eight hundred and eighty nine.
