AFFIDAVIT.
---------------

You shall swear that you believe this to be the true last Will and Testament of Elias Goudie, late of St. John's in the Central District of Newfoundland, Tin-plate worker, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Elias Goudie, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of One Thousand Three -----Dollars.

So help you God.

Notice

After three days from the date hereof application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Probate of the Will of Elias Goudie late of Saint John's in the Central District of Newfoundland, Tin Plate Worker, deceased, to be granted to Mary Goudie, sole Executrix named in said Will.
Dated at Saint John's this fourth day of January A.D. 1888.

The Petition of Mary Goudie of Saint John's, Widow,

Humbly Sheweth

That Elias Goudie late of Saint John's aforesaid, Tin Plate Worker, died there on or about the 29th day of December A.D. one thousand eight hundred and eighty seven, having first made and published his last Will and Testament which is hereto annexed marked "A" of which he appointed your petitioner sole Executrix.
That said deceased at the time of his death was possessed of property of the probable value of Twelve Hundred dollars.
That no probate of any will nor letters of administration of the estate of said deceased have been granted to any person.
Prayed - - - - Petitioner therefore prays that Probate of the said Will of said deceased may be granted to her.
And as in duty bound she will ever pray etc.
Dated at Saint John's this 2nd day of October A.D. 1889.

SUPREME COURT OF NEWFOUNDLAND

TO WIT          James J. Pitman of Saint John's aforesaid, Solicitor, maketh oath and saith that on the twenty fifth day of June A.D. one thousand eight hundred and eighty three at Saint John's aforesaid, he this deponent was present and did see Elias Goudie, late of Saint John's, Tinsmith, the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of James S. Winter of Saint John's aforesaid, Barrister at Law, the other subscribing witness thereto. That Deponent and said James S. Winter then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Eight Hundred and Eighty eight.

"A"

This is the last Will and Testament  of me, Elias Goudie of St. John's, Tin Plate Worker. I bequeath the whole of my estate, real and perfonal, to my wife Mary Goudie for her sole, separate and absolute use and benefit for ever. And I appoint her sole Executrix of this my said Will.
St. John's, June 25th 1883.
