AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of John Fitzgerald alias Hunt late of Brigus in the Northern District of the Island of Newfoundland, Tinsmith, deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said John Fitzgerald alias Hunt, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Eight Hundred and Fifty Dollars.

So help you God.

The Petition of William Hunt of Brigus in the Northern District of Newfoundland, Tin Smith

Humbly Sheweth

That John Fitzgerald alias Hunt late of Brigus aforesaid, Tin Smith, died at that place on or about the seventh day of December in the year of our Lord one thousand eight hundred and eighty-eight.

That the said John Fitzgerald alias Hunt left him surviving as next of kin several uncles of whom your Petitioner is one.

That at the time of his death the said John Fitzgerald alias Hunt was possessed of money, property and effects within the jurisdiction of your Honorable Court of the probable value of Eight Hundred Dollars.

That the said John Fitzgerald made and published his last Will and Testament which said Will is hereto annexed and which has been proven in due form of law by Patrick J. Power one of the subscribing witnesses thereto.

That under the said Will your Petitioner was appointed Sole Executor.

That no Probate or Letters of Administration have as yet been granted to the said Estate.

Your Petitioner therefore

prays that Probate to the said Will may be granted to him,

and as in duty bound your Petitioner will ever pray.

Three days after the date hereof application will be made to one of the Honorable The Judges of the Supreme Court of Newfoundland for Probate to the Will of John Fitzgerald alias Hunt late of Brigus in the Northern District, Tinsmith, deceased to be granted to William Hunt also of Brigus aforesaid, Tinsmith, the Executor named in said Will.

Brigus to Wit
Patrick J. Power of Brigus, Conception Bay, in the Island of Newfoundland, Teacher, maketh oath and saith that on the First Day of December A.D. One Thousand Eight Hundred and Eighty-Eight at Brigus aforesaid he, this Deponent, was present and did see John Fitzgerald alias Hunt, late of Brigus aforesaid, Tinsmith, The Testator named in the paper writing hereunto annexed, duly sign by making his mark the said annexed paper writing as for his last Will and Testament, the same having been read over to him and explained and approved by him, the said Testator in the presence of this Deponent and John Brien of Brigus aforesaid, Tinsmith, the other subscribing witness thereto.
That Deponent and said John Brien then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding to the best of this Deponent's knowledge and belief.

          The Last Will and Testament of John Fitzgerald better known as John F. Hunt of Brigus, CB, Newfoundland.
In the name of God. Amen.
I give and bequeath all and singular the whole of my personal Estate, property and effects of what kind or quality so ever of which the same may be or of which I may die possessed *or entitled unto my beloved uncle William Hunt including my gold watch and chain: Save and except the following bequests. All my clothes both inside and out I give and bequeath to my Aunt Bridget Jackman, except my Mackintosh which I give to my friend John Brien and my best overcoat which I leave to my dear friend Patk. J. Power in remembrance of me. My shaving case I also give and bequeath to the aforesaid John Brien and the gold ring of my late Aunt Ellen I leave to my good and careful attendant Agnes Aspel.
And I do hereby appoint my beloved Uncle William Hunt as sole Executor of this my Last Will, to have masses said for the repose of my soul and to further carry out my last wishes.
Witness my hand this first day of December Anno Domini One Thousand Eight Hundred and Eighty-eight (A.D. 1888).
