Supreme Court of Newfoundland Be it Remembered, That on this Fourteenth day of April in the Fifty Second Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine personally appeared Edward P. Morris of St. John's in the Island of Newfoundland, Barrister at Law, John Burke of same place, Crier and Tipstaff of the Supreme Court, and _________ and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of One Thousand Six Hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:-- NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Edward P. Morris as Administrator de bonis non of the Estate and Effects of Ellen Finn late of St. John's aforesaid, Widow, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Edward P. Morris as such Administratord.b.n. or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 14th day of October next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of him the said Edward P. Morris or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 14th day of April which will be in the Year of Our Lord One Thousand Eight Hundred and Ninety and afterwards from time to time as he/she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue. To the Honorable the Supreme Court or The Petition of E.P. Morris of Saint John's in the Island of Newfoundland, Barrister at Law, Humbly Sheweth as follows That Ellen Finn, late of Saint John's in the Island aforesaid, Widow, died at the above place on the 11th day of April now last past, intestate. That at the time of her death, deceased was possessed of property within the jurisdiction of this Honorable Court of the probable value of Eight Hundred dollars. That the said deceased left her surviving two sisters, Mary Widow of John Walsh and Bridget widow of William Hennessey, the former of Saint John's, the latter of Tilt Cove, Green Bay, and two brothers John and James Curtis of Trepassey in the Island aforesaid and Mary Curtis, a neice (sic) of said deceased. That on the (the) 19th day of April now last past, the said Mary Curtis petitioned this Honorable Court to have the late Prescott Emerson, Esquire, Queens Counsel, appointed administrator of the said Estate which was accordingly granted Page 2 on the 18th of April aforesaid. That the said Administrator died on the 3rd day of February now last past but previous to his death realized the said Estate but did not discharge the same. That your Petitioner has acted as the Solicitor of the said Administrator and also as the solicitor of the said Mary Curtis who is now the only one interested in the said Estate and that Petitioner is still the Solicitor of the said Mary Curtis and is acquainted with the condition of the affairs of the said Estate. That the said Mary Curtis is a judgment ________ against the Estate of the said Ellen Finn's estate to the extent of the total assets of the said Estate and that a portion of the said judgment will need to go to pay the funeral and other expenses of the said Ellen Finn. Petitioner therefore prays that he may be appointed Administrator of the said Estate and as in duty bound he will ever pray. Dated at Saint John's this 18th day of March A.D. 1889. E. P. Morris
