AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Hay Findlater, late of Fogo in the Northern District of the Island of Newfoundland, Medical Practitioner, deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Hay Findlater, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of One Thousand ---------- Dollars.
So help you God.

TO WIT
John Smith of Fogo in the Northern District, maketh oath and saith that on the 9th day of August A.D. one thousand eight hundred and eighty six at Fogo he, this Deponent, was present and did see Hay Findlater, late of Fogo the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of Thomas Adey Torraville the other subscribing witness thereto. That Deponent and said Thomas Adey Torraville then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Petition of John T. Croucher of
Fogo in the Northern District of
Newfoundland, Agent
Humbly Sheweth
That Hay Findlater, late of Fogo aforesaid, Doctor of Medicine, died at Fogo aforesaid in the month of July last leaving him surviving three children - Allan, Isabel and Charles.
That the said deceased left a will which has been proven in due form on the affidavit of John Smith one of the subscribing witnesses thereto which said Will and Affidavit are hereto annexed marked "A".
That in and under said Will, your Petitioner and Allan Findlater were nominated Executors.
That the said deceased at the time of his death was possessed of property and effects of the probable value of One Thousand Dollars and had a fixed place of abode within

the jurisdiction of this Honorable Court, to wit at Fogo aforesaid.
That no probate or administration has as yet been taken out to the Estate of said Hay Findlater, deceased.
Your Petitioner therefore prays that Probate of the said Will of said deceased may be granted to the said Allan Findlater and your Petitioner and as in duty bound he will ever pray.

"A"
I Hay Findlater, of Fogo, in the Northern District of the Island of Newfoundland, Medical Practitioner, do make and declare this to be my last Will and Testament.
FIRSTLY. I direct payment of all my just debts, funeral and testamentary expenses, with all convenient speed after my decease, and subject thereto. I give, devise and bequeath all my estate, real and personal, of what nature or kind soever, whereof I am now or may die possessed unto my three children, Allan Findlater, Isabel Lucretia Findlater, and Charles Findlater, share and share alike.
And I appoint my said son Allan Findlater and John T. Croucher, Accountant

In witness whereof I have hereunto set my hand and seal this Ninth day of August in the year of our Lord One Thousand Eight Hundred and Eighty Six A.D. 1886.
