ST. JOHN'S
To Wit          } I do swear that I believe that Michael Farrell, late of St. John's aforesaid, Chandler, deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eleven Thousand dollars.

In the Matter of the Estate of
Michael Farrell, late of St. John's,
Chandler, deceased.

          On reading the petition of John Harris of St. John's, Merchant, filed in this matter and the affidavit thereto annexed and hearing Kent Q.C. counsel for the said petitioner I do order that the said Petitioner, and the Very Reverend John Scott and Robert J. Kent, both of St. John's who were it is stated the subscribing witnesses to the alleged and now missing Will of the said deceased, and also Robert Farrell of St. John's the son of the said deceased do attend before me in Judge's Chambers, the Court House in St. John's on Wednesday next, the twenty first day of August now present at Twelve o'clock noon for examination and hearing as to the said alleged and now missing will and for such further and other proceedings in relation to the said will as may be necessary in that behalf. And further as to the prayer of the said petition, that administration of the estate of the said deceased be granted to the said John Harris.
Dated, St. John's this nineteenth day of August A.D. 1889.

Be it Remembered, That on this 28th day of August in the Fifty Third Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine personally appeared John Harris of St. John's in the Island of Newfoundland, Commission Merchant, John Henderson of same place, Commission Merchant & Thomas J. Edens of same place, Grocer and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Twenty Two Thousand Dollars, to be had, made and levied on their Goods, Chattels and Effects,  jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden John Harris as Administrator of the Estate and Effects of Michael Farrell late of St. John's aforesaid, Chandler, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Harris as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 28th day of February next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said John Harris or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 28th day of August which will be in the Year of Our Lord One Thousand Eight Hundred and Ninety and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

In the matter of the Will and
and Estate of Michael Farrell,
late of St. John's, Chandler,
deceased.
On reading the order made by me in this matter and dated the nineteenth day of the present month of August and having the examination of the Reverend John Scott and of Robt J. Kent, the witnesses to the alleged and now missing will of the said deceased to the effect that at the time the said deceased signed the said document he was not of mental capacity to make a will. And the evidence of Patrick Farrell, son of the said deceased and of John Harris the petitioner in this matter to the effect that careful search had lately been made by them for the said alleged will and that the same could not be found, I do order that the said document be not admitted to probate as the will of the said decedent. And that administration of the estate and effects of the said deceased be granted to the said Petitioner John Harris of St. John's, Merchant, on his filing the usual security by bond for the due and faithful discharge of his duties as such Administrator.
Dated at St. John's this twenty first day of Auigust Anno Domini 1889.

The Petition of John Harris of St. John's, Merchant

Humble Sheweth

That Michael Farrell of St. John's, snuff and candle manufacturer, died there on or about the third day of August Anno Domini One Thousand Eight Hundred and eighty nine.
That he made a Will about          years ago whereby, as Petitioner is informed and believes, he bequeathed all his property to his wife. That his said wife died before the said Michael Farrell.
That since the death of the said Michael Farrell, diligent search has been made for the said will which, as Petitioner is informed and believes, remained in the possession of the said wife but the same cannot be found.
That he died possessed of property to the probable value of about Ten Thousand Dollars, subject to certain mortgages and charges.
That he left him surviving two sons, one of whom, Patrick, is resident in St. John's aforesaid; the other Thomas is at present in the United States of America.
That your Petitioner is desirous of being appointed administrator of the Estate of the said deceased. That no administration of the said Estate has been hitherto granted. Your Petitioner therefore prays that the matters herein alleged be enquired into and that if said will be not found or be found on enquiry to be invalid, that administration of the Estate of the said Michael Farrell be granted to him.
