In the Supreme Court

AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of Prescott Emerson late of Saint John's in the Central District of Newfoundland, Chief Clerk and Registrar of the Supreme Court of Newfoundland, deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Prescott Emerson, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of  Twenty Thousand Dollars.

So help you God.

Three days from the date hereof I will apply to the Supreme Court or one of the Honorable the Judges thereof for Probate of the Will of Prescott Emerson, ??? Q.C. late of St. John's, C. C. & Registrar of the Supreme Court deceased to be granted to Clara Emerson, widow of deceased.

This is the last Will and Testament of me Prescott Emerson. I will and bequeath all that I may die possessed of to my wife Clara Emerson for her sole and separate use for and during her life and afterwards to my adopted Son Charles Emerson. I invest my wife with full discretion as to the management of my Estate giving her power to sell if necessary in her judgment all land

and personal property and invest the proceeds at her discretion. And I appoint my wife sole Executor of this my Will.

Supreme Court of Newfoundland

St. John's
to wit          } Isaac R. McNeily of St. John's in the Island of Newfoundland, Barrister at Law, maketh oath and saith that he was well acquainted with Prescott Emerson late of Saint John's aforesaid, Chief Clerk and Registrar of the Supreme Court of Newfoundland, deceased; that he was well acquainted with the handwriting of the said deceased; that the paper writing hereto annexed marked A and purporting to be the last Will and Testament of the said Prescott Emerson is entirely in the proper handwriting of the said Prescott Emerson - that the signature "Prescott Emerson" appended to the said Will is in the true and proper handwriting of the said Prescott Emerson. And Deponent further saith that at the time of the signing of the said Will the said Prescott Emerson was of sound disposing mind memory and understanding to the best of Deponent's knowledge and belief.

aforesaid this 7th day of
February A.D. 1889.

To the Honorable the Supreme Court or one
of the Honorable the Judges thereof

The Petition of Clara Emerson of St. John's, Widow

Humbly Sheweth

That Petitioner's husband, Prescott Emerson Q.C., late of St. John's in the Island of Newfoundland, Chief Clerk and Registrar of the Supreme Court, died at St. John's on the third day of February instant having first made his last Will and Testament which is hereto annexed.
That the said Will is wholly in the handwriting of the said deceased and signed by him.
That the said Will has been duly proven by the Affidavit of Isaac R. McNeily, Barrister at Law, a person well acquainted with the handwriting of the deceased.
That deceased died possessed of property within the jurisdiction of this Honorable Court of the probable value of Twenty Thousand Dollars.
That neither Probate of any Will nor Administration to

the Estate and effects of deceased have as yet been granted to anyone.
That under and by witness of the said last Will and Testament of deceased, your Petitioner has been appointed the sole Executrix for the due execution thereof.
Your Petitioner therefore prays that Probate of the said Will may be granted to her as such Executrix.
And as in duty bound she will ever pray.
