AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of George Dicks late of St. John's in the Island of Newfoundland, Sailmaker, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said George Dicks, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Five Thousand Five Hundred Dollars.

So help you God.

TO WIT
Donald Morison, Solicitor, maketh oath and saith that on the ninth day of January A.D. one thousand eight hundred and eighty nine at Saint John's aforesaid, he this deponent was present and did see George Dicks, late of Saint John's, Sailmaker, the Testator named in the paper writings hereto annexed, *marked A & B, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament *and a Codicil thereto in the presence of this Deponent and of Colin Campbell of Saint John's the other subscribing witness thereto. That Deponent and said Colin Campbell then and there signed their names to such Will *and Codicil as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will *and Codicil the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

A

This is the last Will and Testament of me George Dicks of Saint John's Newfoundland, Sailmaker.
First. I desire that all my just debts funeral and testamentary expenses shall be first paid out of my estate and I hereby appoint my son Winser Dicks and my son-in-law Colin Campbell executors of this my Will.
Second. I give devise and bequeath all my estate property goods chattels and effects of every description both real and personal and all monies of which I shall die possessed to my wife Ann Dicks to hold to her for and during her natural life.
Third. Upon the death of my said wife I devise and bequeath the land known as Jenkins Property, now occupied by me situate on the North side of Hamilton Street with the dwelling house, outhouses and all other erections thereon and all appurtenances thereto belonging to my son Winser Dicks for ever.
Fourth. Upon the death of my said wife I bequeath all my household goods furniture and effects to my son Winser Dicks for ever with the exception of the Piano which I hereby bequeath to my daughter May.
Fifth. Upon the death of my said wife I desire that the field purchased by me from Coady situate on the West side of LeMarchant Road

shall be divided into three equal lots fronting on LeMarchant Road and I hereby bequeath to my daughter May the lower or Southern lot together with the piece of land with stable thereon purchased by me from John Coady adjoining said lot and fronting on Hamilton Street to hold to my said daughter for her sole and absolute use for ever. I bequeath the next or middle lot to my daughter Rachel, wife of Colin Campbell for her sole and absolute use for ever. And I bequeath the upper or Northern lot to my daughter Bessie, wife of Avalon March for her sole and absolute use for ever.
Sixth. Upon the death of my said wife I devise and bequeath my interest in the land and buildings occupied by me as a sail loft situate at the corner of Adelaide and New Gower Streets and all my interest in the sail making business carried on by me to my son Winser Dicks for ever.
Seventh. Upon the death of my said wife I bequeath my share and interest in the field fronting on Logy Bank Road to my son Winser Dicks for ever.
Eighth. Upon the death of my said wife I desire that the piece of land purchased by me from George Symonds situate near Blackwoods Farm shall be divided into lots of one hundred feet each measuring from North

to South and I bequeath the first of said lots adjoining the continuation of Hamilton Street to my daughter Rachel, the next lot to my daughter May, the next lot to my daughter Bessie, the next lot to my son Winser and so on in the same order until the said lots are exhausted. To hold the same to my said children respectively for ever and the lots bequeathed to my daughters to be for their sole and absolute use and benefit. I hereby will and direct unless my said children shall otherwise agree among themselves that a road or way of Eight______ feet in width shall be left along the whole of the Eastern side of said land which road or way shall be used in common by my said children and their assigns.
WITNESS my hand at Saint John's this ninth day of January Anno Domini One Thousand eight hundred and eighty nine.

B

This is a Codicil to the within Will.
Upon the death of my said wife, it is my wish and desire and I hereby will and direct that the sum of Eight Hundred Dollars shall be paid to my son Winser for his sole use. The balance of any money that shall remain after payment of the said sum of Eight Hundred Dollars I hereby will and direct shall be divided among my said three daughters in equal shares.
Dated the 9th day of January A.D. 1889.

          The Petition of Winser Dicks of Saint John's, sail maker and Colin Campbell of the same place, Merchant

Humbly Sheweth

          That George Dicks, late of Saint John's aforesaid, Sailmaker, died there on the twenty fifth day of April last past having previously made and executed his last Will and Testament which is hereto annexed.
          That said deceased at the time of his death was possessed of property of the probable value of Five Thousand Dollars.
          That Petitioners are nominated in and by the said Will as Executors thereof and that no probate of any will or administration of the Estate of said deceased has been granted to any person.
          Petitioners therefore pray that Probate of the Will of said deceased may be granted to them.
          And as in duty bound they will every pray &c
          Dated at Saint John's this 2nd day of May A.D. 1889.
