To Wit          }
I do swear that I believe that Thomas Croke , late of St. John's in the Central District, Farmer, deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One Hundred & Thirty Dollars.

In the name of God, Amen.

This last will and testament of Thomas Croke of Logey Bay in the district of St. John's, Newfoundland, Farmer made his will on the thirten day of Decmber 1873 and specify as follows
That I Thomas Croake being in advanced state of life an in Perfect State of health, but at the samea time in a sound and perfect state of mind and memory and understanding do therfour make this my last will and testament and will dispose of my house and farm and property tow my son Patrick Croake. He is tow have foure masses celebrated, tow before I dies and tow after and the sade Patrick Croakes mother is tow have her own home and the use of the house without anny hiddrence and the sowing of one Barrel of potates and six hens and her support

and also tow have four masses celebrated for his mother befoure or after her death and my son William Croake he is tow have the use of the Bog and passage as his Brother and Mike his son is to have the farm after his fathers death.

TO WIT
John Price of Logy Bay in the Central District, Farmer,  maketh oath and saith that on the thirteenth day  of December A.D. one thousand eight hundred and seventy three at Logy Bay aforesaid he, this deponent, was present and did  see Thomas Croak late of Logy Bay aforesaid, the Testator named in the paper writing hereto annexed duly sign, (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of Thomas Cadigan and Luke Lombard the other subscribing witness thereto. That Deponent and said Thomas Cadigan and Luke Lombard then signed their names to such Will as such witnesses in the presence of the said Testator and of each other--That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of Deponent and the said Thomas Cadigan and Luke Lombard and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Notice 

After three days, application will be made to the Honorable the Supreme Court or one of the Honorable Judges thereof for Letters of Administration cum testamento annexo to the Estate of Thomas Croak of Logy Bay in the Central District, Farmer, deceased, to be granted to his son Patrick Croak, a Legatee under the said Will.

The Petition of Patrick Croak of St. John's, Carpenter,

Humbly Sheweth

That your Petitioner's late father Thomas Croak of Logy Bay in the Central District, Farmer, died there on the twenty eighth day of February Eighteen Hundred and Seventy Nine leaving him surviving his widow Mary Croak (who died in the month of November A.D. 1887), Your Petitioner, James Croak residing in Boston, United States of America, William Croak residing in Liverpool, England, Mary Croak married to Michael Dwyer residing at Tilton Harbor in the Northern District and his grandson Michael Croak, son of your Petitioner.
That deceased Thomas Croak duly Executed his last Will and Testament (hereto annexed marked A) and which has been proved in common form.

That your Petitioner is a Legatee under the said Will.
That the consent (hereto annexed marked B) is the consent of Testator's grandson Michael Croak, residuary Legatee under the said Will and who is not of the age of eighteen years.
That no Executor was appointed under the said Will.
That Petitioner believes the value of the property left by deceased to be about one hundred and twenty dollars.
That neither Probate nor Administration to the said Estate has been previously granted.
Petitioner therefore prays that your Lordships will be pleased to grant him Letters of Administration with the Will annexed to the Estate of the said deceased.
And as in duty bound will ever pray.

Be it Remembered, That on this Twenty Fifth day of October in the Fifty third Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine personally appeared Patrick Croke of St. John's in the Central District of Newfoundland, Carpenter, Francis Goshue of St. John's afsd, Tin Smith, John Doran of St. John's afsd, Carpenter, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Two Hundred Sixty Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Patrick Croke as Administrator cum testamento annexo of the Estate and Effects of Thomas Croke, late of Logy Bay in the Central District, Farmer, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Patrick Croke as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the twenty fifth day of April next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of him the said Patrick Croke or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his/her said Administration, on or before the 25th day of October which will be in the Year of Our Lord One Thousand Eight Hundred and Ninety and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
