AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of Catherine Connell late of Harbor Grace in the Northern District of Newfoundland, widow, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Catherine Connell, deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Twenty Four Hundred Dollars.

So help you God.

Notice

Three days after date hereof application will be made to the Honorable the Supreme Court or one of the Honorable Judges thereof for Probate to the Will of Catherine Connell late of Harbor Grace, widow, deceased to be granted to Reverend Edward F. Walsh and Michael Jones of Brigus and Harbor Grae in the Northern District, Executors named in said Will.

The Petition of Edward F. Walsh of Brigus, Roman Catholic Priest and Michael Jones of Harbor Grace, Merchant

Humbly Sheweth

That Catherine Connell of Harbor Grace aforesaid Widow died at St. John's on the twenty ninth day of April last past.
That before her death she made and executed the paper writing hereto annexed as and for her last Will and Testament.
That said Will has been duly proven.
That under said Will your Petitioners are nominated and appointed Executors.
That Testatrix at the time of her death was possessed of property of the probable value of Twenty Four Hundred Dollars.
That no probate or administration has been granted to the Estate of the said Catherine Connell.
Petitioners therefore pray that Probate to the said Will may be granted to them
And as in duty bound they will ever pray.
Dated at Harbor Grace, Newfoundland, this ninth day of July A.D. 1889.

SUPREME COURT OF NEWFOUNDLAND

TO WIT          } Edward F. Walsh at present of Saint John's, Roman Catholic Priest, maketh oath and saith that on the sixteenth day of November A.D. one thousand eight hundred and eighty five at Harbor Grace ???, he this deponent was present and did see Catherine Connell, late of Harbor Grace, Widow, the Testatrix named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for her last Will and Testament in the presence of this Deponent and of Felix D. McCarthy, the other subscribing witness thereto. That Deponent and said Felix D. McCarthy, then and there signed their names to such Will and such witnesses in the presence of the said Testatrix and of each other and that at the time of the said Execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Last Will and Testament of me, Catharine Connell,
Conception Bay in the Island of Newfoundland.

          I Catharine Connell considering the uncertainty of this life and being of sound mind and memory do make and publish this my Last Will and Testament in manner and form following, that is to say:-
My House, Lands, Goods, Chattels, personal effects, property, and estate of every description and of what kind soever of which I shall die possessed, or to which at the time of my decease I shall be legally entitled, together with the use of the Interest of all such money or monies possessed by me at the time of my decease I give and bequeath unto my son David John Joseph Connell for and during the term of his natural life and for his use and benefit during such life time, and after his decease to the direct legitimate heir or heirs of his body should he marry and leave children failing in which I give and bequeath the House unto my cousin Annie Ryan and to her heirs and assigns forever; and the reversion of the rest and residue of my personal estate property, lands and monies both principal and interest with the profits, income and advantage that my result therefrom, I devise and bequeath to be held in trust by the Right Revd Dr. MacDonald, Roman Catholic Bishop of Harbor Grace, Nfld., for the benefit of poor & other charitable purposes. And I do hereby nominate and appoint as Executors to this my Last Will and Testament Revd E. F. Walsh P.P. of Brigus & Michael Jones.
In witness whereof I have hereunto my hand and seal subscribed and set the Sixteenth day of November in the year of our Lord, One Thousand Eight Hundred and Eighty Five.
