AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of Bridget Carrigan late of St. John's in the Central District of the Island of Newfoundland, widow, deceased. You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Bridget Carrigan, deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Four Thousand Five Hundred Dollars.

So help you God.

The Petition of Timothy Phelan of Saint John's, Dealer

Humbly Sheweth

That Bridget Carrigan late of Saint John's Widow died on the 17th day of November last past, having duly made and executed her last Will, which has been duly proved and is hereto annexed.
That under the said Will the Reverend M. J. Clarke Parish Priest, Torbay and your Petitioner were appointed Executors.
That the said Reverend M. J. Clarke renounced such Executorship, which renunciation if hereto annexed.
That the said Bridget Carrigan was possessed of property at the time of her death, within the jurisdiction of the Supreme Court aforesaid, of the value of Four Thousand Four Hundred dollars.
That no Probate of Administration has been granted to said Estate.
Your Petitioner therefore prays that one of your Lordships will be pleased to entrust him with Probate of said Will of Bridget Carrigan.
And as in duty bound will ever pray.

I, Bridget Carrigan, Widow of the late Walter Carrigan late of Saint John's in the Island of Newfoundland, Shopkeeper, do make publish and declare this paper writing to be my last Will and Testament and I hereby annul and make void all former Wills by me made or executed. First I give devise and bequeath unto the Very Revd Archdeacon Forestal the sum of Four Hundred dollars for masses for the repose of my Soul and the Souls of my family and the Soul of my late husband Walter Carrigan and his family. Second I give devise and bequeath unto Honora Phealan daughter of my brother Timothy Phealan the sum of Four Hundred Dollars. Third I give devise and bequeath unto my brother John Phealan of Fethard County Tipperary the sum of Ninety Six dollars. Fourth I give and devise and bequeath unto my nephew James Phealen, son of my brother Thomas Phealen the sum of Eighty dollars. Fifth I give devise and bequeath unto my nephew James Phealen son of my brother Patrick Phealen the sum of One Hundred and Sixty dollars. Sixth I give devise

and bequeath unto Mother Liquori?, Mercy Convent, Military Road the sum of Twenty dollars. Seventh I give devise and bequeath unto Sister Augeta?, St. Patrick's Convent the sum of Twenty Dollars. Eighth I give devise and bequeath unto Mother Frances, my niece, the Revd Mother of the Convent at Torbay, the sum of Four Hundred dollars. Ninth I give devise and bequeath unto the Revd M. J. Clark P.P. Torbay the sum of Twenty dollars. Tenth I give devise and bequeath unto my niece Margaret Phealan daughter of my brother Patrick Phealan the sum of Four Hundred dollars. Eleventh I give devise and bequeath unto my niece Mary daughter of my brother Timothy Phealan the sum of Two Hundred dollars. Twelfth I give devise and bequeath unto my niece Mrs. Garret Fitzgibbon daughter of my said brother Timothy Phealan the sum of Two Hundred dollars. Thirteenth I give devise and bequeath unto my cousin Johanna Quinlan of Rathorpe Kilana?? Co. Tipperary the sum of Forty dollars. Fourteenth I desire my Executors hereinafter named to have the monument and railings in and around any plot of land used as a burying ground at Belvidere placed in good repair. Fifteenth All the rest, residue and

remainder of all property that I may die possessed of, of every description whatsoever, and wheresoever situate, I give devise and bequeath unto my brother Timothy Phealan. The money hereinbefore bequeathed being deposited in the Savings Bank and Union Bank of Newfoundland, as well as my ?????? amount which my brother Timothy Phealan becomes entitled to as my residuary Legatee save and except the sum of Twenty dollars which I hereby bequeath give and devise unto Sister Theresa Cuddihy of Presentation Convent St. John's. Lastly I hereby nominate and appoint the Reverend M. J. Clarke, Parish Priest, Torbay and my brother Timothy Phealan Executors of this my last Will and Testament.
----- In witness whereof I have hereunto my hand and seal subscribed and set at Saint John's Newfoundland this fourth day of November A.D. 1889.

TO WIT
Michael J. O'Mara of Saint John's, Solicitor, maketh oath and saith that on the fourth day of November A.D. one thousand eight hundred and eighty nine at St. John's he, this Deponent, was present and did see Bridget Carrigan late of Saint John's aforesaid the Testatrix named in the paper writing hereto annexed duly sign, (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Patrick Farrell the other subscribing witness thereto. That Deponent and said Patrick Farrell then signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other - That previously to the said Will being so signed as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by, the said Testatrix in the presence of Deponent and the said Patrick Farrell and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
