NEWFOUNDLAND AFFIDAVIT. You shall swear that you believe this to be the true last Will and Testament of John Bartlett late of Brigus in the Northern District of Newfoundland, Planter, deceased. You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said John Bartlett, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Twenty Five Thousand Dollars. In the Name of God, Amen. This Last Will and Testament of me John Bartlett, Planter of Brigus, Conception Bay, Newfoundland was made this eighth day of April one thousand eight hundred and eighty six. I appoint my son Moses Bartlett and my nephew John Bartlett of Brigus aforesaid as Executors of this my Last Will and Testament. I give and bequeath to my four children Selina Patience, Anne, Moses, Jane Emma the Fifteen Shares in the Capital Stock of the Commercial Bank of Newfoundland to be equally divided among them, share and share alike. I give and bequeath to my son Moses the dwelling house at River Head, Brigus aforesaid together with Stable, Store, Carriage House, gardens and premises attached with all beds, bedding & furniture contained within the said dwelling house save & except the bequests hereinafter mentioned; horse and carriage & farming gear I give and bequeath to the aforementioned Moses Bartlett, my son; also my water side premises at River Head together with the water side which I bought from John Antle near James Norman's Store, 25 feet frontage & going back to the public road I give and bequeath to my son Moses aforesaid. The Schooner "Victor" with all fishing gear together with the premises at Domino, Labrador fishing room, stages, boats & all belonging to me at Page 2 Domino. I further give and bequeath to my son Moses Bartlett aforesaid the garden situate at Brigus and known as Uncle Peter's garden, I give and bequeath to my son Moses Bartlett. To my daughter Selina Patience Bartlett I give and bequeath £200 cash together with the House and Stable with garden & land attached thereto, situate near the Pond, Middle Ridge, Brigus. I further devise that she have the use of the bedroom she now occupies as long as she lives in the house at River Head with her brother Moses. I further give & bequeath to her two feather beds with bedding & the bed stead she now To my daughter Anne Bartlett I give & bequeath £170 in cash together with the Piano, also the House now in possession of George Gushue situate in Brigus aforesaid together with the land attached to the said house running back to Sprackland Estate. I further devise that she have the use of the bedroom in the House at River Head now occupied by me & known as Father's bed room. To my daughter Jane Emma Bartlett I give and bequeath £150 in cash, together with the Harmonim; also the House now in possession of Geo. C. Jarrett situate in Brigus aforesaid with land attached thereto. I further devise that she have the use of the bed room she now occupies together with two feather beds and bedding and bedstead. Page 3 The farm known as the South Farm situate in Brigus aforesaid I give and bequeath to my four children, Selina Patience, Anne, Moses, Jane Emma; the land with house thereon to be equally divided among them. The house now in the occupancy of William Mitchell situate near Beaver Pond, Brigus, I give and bequeath to my grandson Joseph Bartlett, son of Isaac. Whatever may be owing to me from money advanced towards the completion of Salmon Cove Church, I give & bequeath to the Diocesan Synod of Newfoundland, for the benefit of the Brigus Endowment Fund. To each of my four children aforementioned, I give and bequeath a pew in S. Georges Church, Brigus. Whatever monies may be left when all just debts and the aforesaid legacies have been paid, I desire shall be equally divided among my four children aforesaid viz; Selina Patience, Anne, Moses, Jane Emma Bartlett. And hereby revoking all other Wills and testamentary dispositions by me heretofore made, I declare this to be my last Will and Testament this Eighth day of April One Thousand Eight Hundred and Eighty Six. This is a Codicil to my will dated the eighth day of April Anno Domini eighteen hundred and eighty six. I revoke that portion of my will by which I have given and bequeathed certain Commercial BankStock*, the Schooner "Victor" and other property to my son Moses and I give and bequeath all the said Commercial Bank Stock, the Schooner "Victor" and other property by my said will bequeathed to my son Moses unto Louisa, wife of my said son Moses, to her sole use for and during her natural life and after her decease to such of her children by her present husband should she leave any such children her surviving or to her present husband or to any of his next of kin as she may by Will duly executed appoint and in case of her failing so to appoint, then the same shall go to my said son Moses and his heirs. Provided always that the said Louisa may at any time with the sanction of my said *son sell and dispose of the said Commercial Bank Stock, the Schooner "Victor" and the said other propertys (sic) or any part thereof and apply the proceeds to such purpose and in such a manner, as my said son Moses may approve of in writing. To the Honourable the Supreme Court The Petition of Moses Bartlett and John Bartlett, both of Brigus in Conception Bay in the Island of Newfoundland, Planters. Humbly Sheweth That John Bartlett, late of Brigus aforesaid, Planter, departed this life on the sixth day of February instant having made his last Will and Testament dated the eighth day of April Anno Domini Eighteen Hundred and Eighty Six of which he appointed your Page 2 Petitioners Executors and having subsequently ????? a codicil to the said Will.
