ST. JOHN'S }
To Wit          } I do swear that I believe that John Sparks, late of St. John's aforesaid, Master Mariner, deceased died with a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of *sixeight hundred dollars.

It is my, John Sparkes wish, before leaving home to go on a forran (sic) voig (sic) today to make a statement in favour of my wife - that is to say should any thing happen (sic) to me, my wife Charlotte Sparkes is to have all my worldly pocasion (sic) money and property to despose (sic) of in any way she may think best for her supert (sic) and maintainance (sic) so long as she remains in my name but after her death or mareige (sic) what ever of money or property may be left is to go to my Father, James Sparkes.

SAINT JOHN'S to wit } Eli Tuck of Saint John's in the Island of Newfoundland, Tidewaiter, maketh oath and saith that he was acquainted with John Sparkes, late of Saint John's aforesaid, Master Mariner and knew the handwriting of the said John Sparkes.
That the paper writing ????? hereto annexed purporting to be the last Will and Testament of the said John Sparkes is in the true and proper handwriting of the said John Sparkes and that the signature of John Sparkes at the foot of the said paper writing is also in the true and proper handwriting of him, the said John Sparkes.
That this deponent subscribed his name to the said paper writing hereto annexed in the presence and at the request of the said Testator who declared the said annexed paper writing to be his last Will and Testament in the presence of this deponent and that at the time of the making date of the said Will, the said Testator was of sound and disposing mind, memory and understanding to the best of deponent's knowledge and belief.

Affidavit in proof of will.

 

 

To the Honourable the Supreme Court or one of Your Lordships, the Judges thereof.

The Petition of Charlotte Sparkes of Saint John's in the Island of Newfoundland, Widow.

Humbly Sheweth

          That John Sparkes of Saint John's aforesaid, Master Mariner, died at sea in the year One thousand eight hundred and eighty seven.
          That the said John Sparkes executed a Last Will and Testament which is in the true and proper handwriting of the said deceased and which said Last Will and Testament is hereunto annexed.
          That the said testator left him surviving Your Petitioner, his widow, and his father, James Sparkes.
          That at the time of his death the said testator was possessed of property within the jurisdiction of this Honourable Court to the probable value of Five hundred dollars.
          That no application has heretofore been made to this Honourable Court for Probate to the said Will or Letters of Administration to the estate of the said John Sparkes.
          Your Petitioner therefore humbly prays that Your Honourable Court or one of Your Lordships the Judges thereof will be pleased to grant unto her Letters of Administration cum testamento annexo to the estate and effects of her said husband, the late John Sparkes.
          And as in duty bound Petitioner will ever pray.
          At Saint John's this 16th day of June A.D. 1888

Be it Remembered, That on this Twentieth day of June in the Forty Fifty first Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-eight personally appeared *CatherineCharlotte Sparkes of St. John's in the Central District, Widow, Eli Tuck of St. John's aforesaid, Tidewaiter and George Robert Bowden also of St. John's aforesaid, Master Mariner, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of  One Thousand Six Hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects,  jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden **CatherineCharlotte Sparkes as Administratrix C.T.A. of the Estate and Effects of John Sparkes late of St. John's aforesaid, Master Mariner, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Charlotte Sparkes as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 20th day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Charlotte Sparkes or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 20th day of June which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
