To Wit      } I do swear that I believe that John C. Simmons, late of Harries Harbor, Notre Dame Bay in the Northern District of Newfoundland, Fisherman, deceased died with a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight Hundred dollars.

Harries Harbor, ??????????? 4th in the year of our Lord one thousand eight hundred and Eighty Eight.
I John C. Simmons do certify this is my Last Will and Testament.
This is to certify that all my property, houses, land and the above property Will be divided into five parts after my decease. My wife Julia Simmons, Willis T. Simmons, Ubert Simmons, Archabald (sic) H. Simmons, John Eliser (sic) Simmons, will receive equal parts and John Eliser Simmons will receive his part of said property at the age of twenty one years.
The vessel which I hold is to be sold. When sold, my wife Julia Simmons will receive fifty pounds £50 cy. The remainder of money received for the said Vessel will be devoided (sic) between Willis J. Simmons, Ubert Simmons, Archabald H. Simmons, John Eleser Simmons.

TO WIT
George Gordon Henry Knight * of Harries Harbour, Notre Dame Bay, Fisherman, maketh oath and saith that on the fourth day of January A.D. one thousand eight hundred and eighty eight at Harries Harbor aforesaid he, this Deponent, was present and did see John C. Simmons late of Harris Harbor aforesaid the Testator named in the paper writing hereunto annexed duly sign (by making    mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Henry Knight George Gordon of Harries Harbor aforesaid, fisherman, the other subscribing witness thereto. That Deponent and said George Gordon Henry Knight then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said George Gordon Henry Knight and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

NOTICE

After three days application will be made to the Honorable the Supreme Court of Newfoundland or to one of the Honorable Judges thereof for Letters of Administration cum testamento annexo of the estate of John C. Simmons, late of Harries Harbor, Newfoundland, fisherman, deceased, to be granted to his wife Julia Simmons of the said place.
          The 3rd day of December A.D. 1888

I hereby certify that the notice on the other side hereof written has been posted in my office from the day of the date thereof to this date and that no caveat or other objection thereto has been filed or entered.

          The Petition of Julia Simmons of Harries Harbor in Notre Dame Bay, Newfoundland, widow

Humbly Sheweth

          That John C. Simmons, late of Harries Harbor aforesaid, fisherman, died on or about the 7th day of Jany last (1888) having first made his last will and testament hereunto annexed of which will he did not appoint an executor.
          That the said deceased left him surviving his widow, the present petitioner, and four children namely Willis T. Simmons, Hubert Simmons, Archibald H. Simmons and John Eliezer Simmons.
          That the estate of the said late John C. Simmons at the time of his decease did not and does not now exceed in value the sum of Eight Hundred doldlars.
          That no letters of administration of said estate have been granted.
          Your Petitioner therefore humbly prays that letters of administration cum testamanto annexo of the said estate be granted to her, the said Julia Simmons.
          And your petitioner as in duty bound will pray.

Be it Remembered, That on this Fourteenth day of Novr in the Forty Fifty First Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-eight personally appeared Julia Simmons of Harries Harbor, widow, George Quenby of Little Bay, Accountant, George Gordon of Harry's Harbr, fisherman, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Sixteen Hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Julia Simmons, as Administratrix cum testamento annexo of the Estate and Effects of John C. Simmons late of Harries Harbor aforesaid, fisherman, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Julia Simmons as such Administratrix cum testamento annexo or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 14th day of May next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Julia Simmons or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 14th day of Novr which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-Nine and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
