To the Honorable the Supreme Court or one of their Lordships the Judges thereof:
The Petition of John Smith of Saint Johns Farmer.
Humbly Sheweth
That William Quigley late of Saint Johns aforesaid Farmer, died at the same place on or about the second day of July A.D. One thousand eight hundred and eighty seven having previously made his last will and Testament which is hereunto annexed and appointed Your Petitioner Executor thereunder.
That the said William at the time of his death was possessed of property within the jurisdiction of this Honorable Court to the probable value of less than one thousand dollars.
That the said William Quigley at the time of his decease left him surviving a widow and four children viz: three daughters Mary Jane wife of Michael Fitzgerald Sarah wife of Daniel Cahill, and Elizabeth wife of Michael Bolger and two sons William Quigley and George Quigley
That no application for Probate to the said Will or for Letters of Administration to the estate of the said William Quigley has heretofore been made to this Honorable Court. Your Petitioner therefore prays that Probate to the said Will mat be granted unto him.
And as in duty bound Petitioner will ever pray

This is the Last Will and Testament of me William Quigley of Saint John's farmer I give and bequeath all the property both real and personal of which I may die possessed to my beloved wife Catherine Quigley for her lifetime and after her death to my sons William Quigley and George Quigley equally between them. And thereby appoint John Smith of Saint John's Farmer Executor of this my last Will.

of Saint John's aforesaid Solicitor maketh oath and saith that on the eighth day of April A.D. one thousand eight hundred and eighty seven at Saint John's aforesaid he, this Deponent, was present and did see William Quigley late of Saint Johns Farmer the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of P. J. Delaney the other subscribing witness thereto. That Deponent and the said P.J. Delaney then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over and approved of by the said Testator in the presence of Deponent and the said P.J. Delaney and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

You shall swear that you believe this to be the true Last Will and Testament of William Quigley late of Saint John's in the Central District of Newfoundland, Farmer, deceased
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said William Quigley Deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of one thousand two hundred dollars
