To the Honourable the Supreme
Court of Newfoundland
or to one of the Honourable the
Judges thereof.

          The petition of William Swansborrow of Topsail in Newfoundland aforesaid Farmer

Humbly Sheweth

          That Sarah Pittman late of New Perlican in the Northern District of Newfoundland Widow deceased died in or about the year of our Lord Eighteen hundred and sixty four? with a will which is hereunto annexed marked A.

          That at the time of the decease of the said Sarah Pittman she was possessed of property of the probable value of one hundred dollars.

          That your petitioner was appointed Executor of the last will and testament of said late Sarah Pittman

          That no letters of Probate or administration of said estate have been granted.

          Your petitioner therefore humbly prays that your Honorable Court or one of the Honorable Judges thereof will grant probate to him of the will of the said late Sarah Pittman

 

          And as in duty bound will ever pray

          Dated at St. Johns Newfoundland this 6th day of March AD 1888

SUPREME COURT OF NEWFOUNDLAND

ST. JOHN'S }
TO WIT        }
William Swansborough of Saint Johns, Central District, Farmer maketh oath and saith that on the Thirtieth day of September A.D. one thousand eight hundred and eighty sixty [sic] two? New Perlican he, this Deponent, was present and did see Sarah Pittman late of New Perlican the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of George Gardner, Clerk in Holy Orders the other subscribing witness thereto. That Deponent and said George Gardner and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

In the Name of God Amen

I Sarah Pittman Relict of the late William Pittman of the Settlement of New Perlican in the Island of Newfoundland, being of a sound Mind Memory and understanding but in Weakness of body and mindful of my latter and Do make this to be my last Will and Testament. That is to say, First, I commend my Soul into the hands of Almighty God in the hope of his mercy through the merits and death of my only Saviour Jesus Christ, and my body to the Ground to be buried with the decency and Order of the Church of England.
Item; I give and bequeath to my Son Charles Pittman, only during his life, my share of the Room at New Perlican at present owned & occupied by myself & my son Albert Pittman & the Heirs of my Sons James Pittman & Corbet Pittman and after the decease of my Son Charles Pittman to be equally divided among the others at present occupying the Room with me.
Item: I give & bequeath to my Daughter Amelia Lockyer a sett [sic] of China Ware.
Item: I give & bequeath to my Son Albert Pittman a feather Bed, Pillow & Bedding
Item: I give & bequeath to my Daughter Amy Pitts a White Quilt, a table, Eight Silver Spoons and a Silver Sugar Tongs

 

Item: I give & bequeath to Sarah daughter of Albert Pittman a Feather Bed, Bedding &c.
Item: I give and bequeath to my Son George Pittman the piece of Ground on which his House is erected at New Perlican, and my Eight Day Clock.
Item: I give & bequeath to Albert Augustus Son of Albert Pittman a ??? gl???.
Item: I do hereby appoint Mr. Wm. Swansborough to be the sole Executor of this my last Will & Testament, requiring him first to discharge all my just Debts & funeral expenses - revoking all others & declaring this to be my Last Will and Testament

AFFIDAVIT

You shall swear that you believe this to be the true Last Will and Testament of Sarah Pittman late of New Perlican in the northern District widow deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Sarah Pittman Deceased, and of which she died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of one hundred and fifty dollars
