AFFIDAVIT
----------

You shall swear that you believe this to be the true Last Will and Testament of William Mullowney late of Saint Johns in the Central District of Newfoundland, Painter, deceased. You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said William Mullowney Deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of two thousand five hundred dollars

To Wit     }

          Robert I. Kent of St. John's in the Central District, one of Her Majesty's Counsel, maketh oath and saith that on the 22nd day of March A.D. one thousand eight hundred and eighty eight at St. John's aforesaid he this deponent was present and did see William Mullowney late of St. Johns aforesaid, the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of John P. Kent, the other subscribing witness thereto. That Deponent and said John ? Kent then and there signed their names to such Will as such witness in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I William Mullowney of St. Johns painter do make publish and declare this as and for my last will and testament. First I direct that all my just debts funeral and testamentary expenses shall be paid. Second. I give devise and bequeath to my sister Mary the sum of Eighty dollars. Third. I give devise and bequeath to the Reverend Superioress for the time being of the Convent of Mercy on the Military road in St. Johns the sum of forty dollars for the use and purposes of that Convent. Fourth. Whatever interest right a (sic) title I may have in the house and premises where I now reside I give devise and bequeath to Ellen Crowley who now resides with me. Fifth. I direct that my household furniture and effects in and about the said house and premises shall be sold by my executor hereinafter mentioned and the net proceeds of such sale after payment of all the cost expenses and outlays attendant thereon shall be paid to my sister Amelia if she be alive and if not alive? then the same shall be paid to her surviving children in equal shares. Sixth. I give devise and bequeath to the Reverend Father Lalor of St. Johns the sum of Ten Dollars for masses for the repose of my soul and the souls of my mother and father. Seventh. As regards the rest residue and remainder of

 

my goods, chattels, property and effects of every nature and kind and wherever situate. I give devise and bequeath the same to my father Patrick Mullowney of Waterford Ireland. Eighth. I do hereby nominate and appoint my friend Thomas Conway of the Queen's ??? in St. Johns as executor of this my will. Ninth: I do hereby revoke and declare null and void all wills by me heretofore made ---

The Petition of Thomas Conway of St. Johns Dealer

Humbly Showeth

That William Mullowney late of St. Johns House and sign painter and glazier died there on or about the fifteenth day of this present month of April having made his last will and testament as hereto annexed and which will has been proved in Common form. That so far as your petitioner is aware the said Testator has no next of kin him surviving resident in Newfoundland. That he died possessed of property situate within the Jurisdiction of this honorable Court of the probable value of about Two thousand two hundred dollars -
that in and by his said last will and testament he nominated and appointed your petitioner as executor thereof. That no probate of any will a (sic) administration of the estate of the said testator has been hitherto granted. Your petitioner therefore prays that probate of the said will may be granted to him and as in duty bound he will ever pray &c &c
