IN THE SUPREME COURT

AFFIDAVIT
--------

You shall swear that you believe this to be the true Last Will and Testament of Ellen Mullowney late of Saint Johns in the Central District of Newfoundland Widow
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Ellen Mullowney Deceased, and of which she died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of twenty nine thousand dollars

So help you God

This is the last Will and Testament of me Ellen Mullowney of St. John's in the Island of Newfoundland Widow. I give and bequeath unto my daughter Ellen Mullowney all the Union Bank shares which I may be possessed of at the time of my death for her separate use free from the debts control or interference of any husband. It is my wish that my niece Ellen Ryan is to be supported as long as she lives in my house and in the event of her marrying with the approval of my Executors she is to receive one hundred pounds. I bequeath unto my daughter Anastasia Maria Alexander all the residue of my Estate and effects of whatever description and wherever situate for her separate use free from the debt control or interference of her present or any future husband. In the event of my said daughter Anastasia Maria departing this life without leaving issue by her marriage, all the property hereby bequeathed to her is to revert to my said daughter Ellen Mullowney.
I appoint my friend William P. Walsh of St. John's aforesaid Executor and my said daughter Ellen Executrix of this my last will and Testament.
In witness whereof I have hereunto set my hand this 21st day of March? AD 1883

the presence of each other have hereunto

SUPREME COURT OF NEWFOUNDLAND

St. John's }
To Wit     } Michael H. Carty of St. John's Solicitor maketh oath and saith that on the 21st day of March A.D. one thousand eight hundred and eighty three? at St. Johns aforesaid - he this Deponent was present and did see Ellen Mullowney late of St. Johns Widow the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Richard Woods - the other subscribing witness thereto. That Deponent and said Richard Woods then and there signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The petition of Ellen Mullowney of St. John's Spinster

Humbly Sheweth

That your petitioner's Mother Ellen Mullowney of St. John's aforesaid Widow departed this life on the twelfth day of August instant leaving her surviving as next of kin two daughters Anastasia Maria Alexander and your petitioner

That the said deceased made her last will which has been duly proved and is hereto annexed wherein she appointed William P. Walsh of St. John's Executor and your petitioner Executrix.

That the said William P. Walsh freely and voluntarily renounced the Executorship of the Will.

That the said deceased was at the time of her death possessed of property of the probable value of Twenty Eight thousand dollars

That no Probate or Letters of Administration to said Estate has been taken out or applied for

Your petitioner therefore

 

prays that Probate to said Will be granted to her
And as in duty bound she will ever pray

          Dated at St. John's this 18th day of August AD 1888.

          That I have not in any way intermeddled with the said Estate or done any act in connection with the said will of the said Estate.
