IN THE SUPREME COURT }

AFFIDAVIT.
--------

You shall swear that you believe this to be the true Last Will and Testament of Isaac Morgan late of Port de Grave Fisherman deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Isaac Morgan Deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of one hundred dollars

The petition of Moses Morgan of Port de Grave at present of Saint Johns Fisherman

Humbly Sheweth

          That Isaac Morgan late of Port de Grave Fisherman died there in the Month of April last having previously made and executed his last will and testament which is hereto annexed and of which he appointed your petitioner Sole executor
          That said deceased at the time of his death was possessed of property of the probable value of Eighty dollars
          That no probate of any will nor administration of the Estate of said deceased has been granted to any person

          Petitioner therefore prays that Probate of the will of Said deceased may be granted to him
          And as in duty bound he will ever pray &c
          Dated at Saint Johns this 23rd day of November AD 1888

In the Name God, Amen

          I Isaac Morgan of Blow me down near Port de Grave, Conception Bay, in the Island of Newfoundland, fisherman, being very infirm, and weak of body, but of perfect mind and memory, thanks be given unto God, therefore calling unto mind the mortality of the body, knowing that it is appointed unto all men once to die, do make and ordain this my last will and testament; that is to say, principally and first of all, I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth, to be buried in decent Christian burial at the discretion of my Executor, nothing doubting but at the general resurrection I shall receive the same again by the Almighty power of God.
          And as touching such worldly estate wherewith it hath pleased God to bless me in this life, I give devise, and dispose of the same, as follows - viz - whereas my nephew Moses Morgan has maintained and supported me for some time past - as agreed to in a document drawn up between us dated 28 Dec'r 1877 - I do hereby will and bequeath to him, his Heirs &c - all and every thing belonging to me, including, house, furniture, fishing room & gardens, (except one feather bed, and my late wife's clothing.) which I have already disposed of -
          I also do hereby constitute make and ordain the said Moses Morgan to be

 

my sole Executor to this my last will and testament, And I do hereby utterly disallow, revoke, and disannul all and every other former testaments wills legacies bequests and executors, by me in any ways before named willed & bequeathed,
          In Witness whereof I have hereunto set my hand and seal at Port de Grave aforesaid this third day of January A.D. 1879

To Wit     } I Henry William Taylor of Port de Grave Fisherman maketh oath and saith that on the third day of January Anno Domini One thousand eight hundred and seventy nine at Port de Grave aforesaid, he this deponent was present and did see Isaac Morgan late of Port de Grave aforesaid fisherman deceased, the Testator named in the paper writing hereto annexed duly sign by making his mark, seal publish and declare the said annexed paper writing as and for his last Will and Testament in presence of this Deponent and of Edward Butler of Port de Grave Fisherman the other subscribing witness
That the said annexed paper writing was first read over and explained to the said Testator. that Deponent and the said Edward Butler then and there signed their names to said Will as such Witnesses in presence of the said Testator and of each other, and that at the time of the Execution of the said Will the Testator was of sound and disposing mind memory and understanding, to the best of Deponent's knowledge and belief.
