To the Honourable the Supreme Court The Petition of Philip F. Clement of La Poile Merchant Humbly Sheweth That on or about the year 1869 one Thomas Kerley of Burnt Island Planter died leaving him surviving his widow That said Thomas Kerley died intestate That the exact value of the Estate of deceased is unknown to your petitioner but the Widow of said deceased sold to the Mercantile Firm of De Grouchy Renouf Clement ??? a certain schooner value for about one Thousand Dollars That upon the dissolution of the above Copartnership it was found that by reason of the failure of the Widow of said deceased to take administration to her late husbands Estate the Copartnership concern were unable to transfer said schooner That no probate or administration has been granted or applied for in respect of this Estate so far as petitioner so
informed. Petitioner prays that administration may be granted to him or to such other person as the Court may appoint. And as in duty bound he will ever pray Philip F. Clement

In the Supreme Court In the Estate of Thomas Kerley of Burnt Islands, Planter deceased at the instance of Philip F. Clement claiming as a creditor of Thomas Kerley. It is ordered that Kerley, Widow of said Thomas Kerley of Burnt Islands do show cause if any she have why Administration to the Estate of the said Thomas Kerley should not be granted to the said Philip F. Clement, by filing in the Registrar's office and serving on the said Philip F. Clement our answer containing the grounds on which she resists such grant on or before the first Monday in July now next ensuing otherwise the claim of the said Philip F. Clement will be taken to be admitted by her. ??? McNeily Proctor By the Court
Supreme Court of Newfoundland Be it Remembered That on this Twenty-sixth day of July in the 52nd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-eight personally appeared Michael Gilliam of Channel in the Southern District of the Island of Newfoundland, Planter, George Poole of Burnt Island in the said District, Planter, and Susan Kerley, of Burnt Island aforesaid Widow, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Four thousand Dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :--- Now the Condition of this Obligation is such, that if the above bounden Susan Kerley as Administratrix of the Estate and Effects of Thomas Kerley late of Burnt Island deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Susan Kerley as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the twenty-fifth day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Susan Kerley or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the Twenty-fifth day of January which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
