To the Honorable the
Supreme Court or to one
of the Honorable Judges
thereof

          The petition of the Reverend John Scott and Edward Rawlins both of St. John's in the island of Newfoundland

Humbly Sheweth
as follows:

          That Thomas Howe formerly of St. Johns aforesaid Licensed Publican died there on or about the sixteenth day of December? now last past having just made and executed his last will and testament hereto annexed p???? in co???? ???? upon the Oath of Edward P. Moores Barrister at Law one of the subscribing witnesses to the same
          That in and by his said last will and testament the said Testator nominated and appointed your petitioners his Executors

 

          That at the time of his death the said Testator was possessed of property within the Jurisdiction of this Honorable court of the probable value of thirty six hundred dollars.
          That no probate or administration to his Estate has been hitherto granted
          Petitioners therefore pray that Probate to the said will may be granted to them as Executors thereof and as in duty bound they will ever pray &c

This is the last will and testament of me Thomas Howe at present of Saint Johns in the island of Newfoundland licensed Publican. First I devise and bequeath to my son James Howe all my right title ???? entered? in and to that dwelling House now occupied by me and all ???? ???? in trade and furniture in said house and all the outhouses and all the stock therein including horse carriage and harness. it being understood that during the life time of my wife she shall live if she choose in the said dwelling house and be provided for by my said son James in exactly the same condition as she now is and have the same control in and over the said house and business as she now has. Second it is my will and desire that should my said wife wish to permanently reside out of the said house my said son James shall pay her out of the proceeds of such business stock property and monies which shall come to him under this my will an annual allowance of forty pounds currency giving at the same time to my Executors hereinafter mentioned good and sufficient security for the payment of the same Third I devise and bequeath to my said son James all my right title and en???? do and to that property situate ??? Monday Pond Road and ???? ??? "Castle Hall" and all the ???? ???? and the farm stock of every description thereon. Fourth I devise and bequeath to my daughter Anne now wife of one Halley the sum of three hundred and fifty pounds free

Fifth it is my will and desire that should my son James go out of the business at present carried on by me at any time after twelve months from the date of my decease he shall be paid by my Executors hereinafter mentioned the sum of three hundred pounds and the then balance of any monies remaining in the hands of my Executors and my ????tered? in the said shop and dwelling house outhouses stables stock in trade and all furniture therein shall go to my said wife for her sole use and benefit during her life and at her death the same shall go to my daughter Anne aforesaid for her sole use and benefit free from the control of her present or any future husband that she may have. I desire that ??? of whatever monies shall be left by me at my death my executors hereinafter mentioned shall first pay all my just debts for ???ial and testamentary bequests. I appoint the Reverend John Scott of Saint Johns aforesaid and Edward Rawlins of same place Executors of this my will.
As witness whereof I have hereunto set my hand this nineteenth day of July Anno Domini one thousand eight hundred and eighty-seven

To Wit
Edward Pittersis? of St. John's Barrister at Law maketh oath and saith that on the 19th day of July A.D. one thousand eight hundred and eighty seven at Saint Johns he, this Deponent, was present and did see Thomas Howe late of St. Johns aforesaid the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Edward Rawlins of S. John's aforesaid Dealer the other subscribing witness thereto. That Deponent and said Edward Rawlins then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over and approved of by the said Testator in the presence of Deponent and the said Edward Rawlins and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

You shall swear that you believe this to be the true Last Will and Testament of _____________ Thomas Howe late of Saint John's in the Central District of Newfoundland Licensed Publican deceased __________________________

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true Account into the Registry of the Supreme Court of Newfoundland when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattles, Assets, Credits and Effects of the said Thomas Howe aforesaid, Deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of four thousand dollars

So help me God.
