Twillingate }I do swear that I believe that William Hardiman of
To Wit        }Durrell's Arm, Twillingate deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court,  do not, according to the best of my knowledge, judgment and belief, amount to the value of One Hundred dollars.

To the Honorable the Chief Justice and Assistant Justices of the Supreme Court, St. Johns, Newfoundland, the Petition of the undersigned Josiah Colbourne, Post Master of Twillingate in the Northern District of the Island of Newfoundland, Humbly Sheweth,
          that your Petitioner was appointed Executor under the Will of the late William Hardiman of Durrels Arm, Twillingate, said Will being dated 17th January 1887, and signed by George H. Pearce as attesting witness and that on the 25th day of June 1887, a Codicil was drawn, signed by Robert Dally, and George Snow, who make their mark as attesting witnesses, both witnesses being unable to write.
          Your Petitioners fear that the will is not valid owing to the fact of there being only one attesting witness to the Testator's signature.
          The Petitioner begs to forward the original will and codicil, and would respectfully pray that if Probate cannot be granted, that letters of Administration might issue?, and he be appointed Administrator to sell the Estate for the benefit of the only child or relative of the deceased, a daughter named Anne Hardiman

 

and who is now, or was lately, a resident or inmate of the Lunatic Asylum, St. John's, and as your Petitioner hears, is now quite sane.           Your Petitioner has made affidavit of Executorship and also as to the estimated value of the estate, and he binds himself to dispose of the proceeds of the sale of the property, strictly as your Honorable Court may direct or order, after paying all legal expenses.
          And your Petitioner as in duty bound will ever pray,

          This Deponent Josiah Colbourne,  Post Master of Twillingate, in the Northern District of the Island of Newfoundland maketh oath and saith that he was appointed Executor under the Will of the late William Hardiman of Twillingate aforesaid in trust for the only child of the Testator, Anne Hardiman during her natural life that the property left is very small, being of the estimated value of Sixty dollars only, and that he now asks to be relieved of the responsibility by the sale of the said property, under the direction of the Honorable Supreme Court.

          I, William Hardiman, of Durrell's Arm South Island Twillingate, Newfoundland, In addition to my last Will and Testament dated January 17th 1887, give and bequeath to Mrs. Thomas Dalley my Bed and Bedding. I give and bequeath to Mrs. Dorcas Gillott one wooden chest and its contents. To my daughter Anne Hardiman I bequeath to Isabella Stuckless my Book of Common Prayer, Bible, and another book entitled "The Whole Duty of Man"?
In witness whereof I have hereunto set my hand this twenty-fifth day of June one thousand eight hundred and eighty seven

          This is the last Will and Testament of me William Hardiman of Durrels Arm, South island of Twillingate in the Northern District of the Island of Newfoundland
          After paying all my just debts and funeral expenses, I leave my property as follows - All my Household Furniture and the premises I now occupy I give and bequeath in Trust to Josiah Colbourne Esq're He to retain possession of the same for the interest of my only daughter Anne Hardiman during her natural life - after her death the said Josiah Colbourne or his assigns shall sell the said premises and Household Furniture and expend the proceeds of the same for the benefit of Her Majesty's Government in relieving the Widows and orphans of Twillingate North and South Islands -
          In Witness whereof I have hereunto set my hand and seal at Durrel's Arm aforesaid this seventeenth day of January A.D. One thousand eight hundred and eighty seven

Be it Remembered That on this Twenty seventh day of April in the 51st Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-eight personally appeared Josiah Colbourne of Twillingate, William Thomas Baird, Blacksmith of Twillingate and Andrew Joseph Pearce, ??? collector of Her Majesty's Customs, Twillingate and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Two (Cannot read the full amount) Dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Josiah Colbourne as Administrator of the Estate and Effects of William Hardiman late of Twillingate deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Josiah Colbourne as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the twenty seventh? day of October next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Josiah Colbourne or to the hands or possession of any other person or persons for shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the twenty seventh day of April which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
