In the name of God Amen I Edward Flaherty of Gasters Conception Bay, Planter do make ordain and publish the following as and for my last will and testament. To my son James Flaherty I will and bequeath subject to the bequests hereinafter ??? all my lands chattels effects to have and hold the same during his life time and on his demise without issue I will and bequeath the land on which my dwelling house is erected together with said house the kitchen garden appurtenant? thereto and sufficient of my ground for the spring or planting of two barrels of seed potatoes to Anne wife of said James and Patience Gorman my granddaughter to hold the same as share and share alike as tenants in common. In the event of the death of said Anne or her remarriage, then said Patience Gorman shall hold the same absolutely. On my said son so dying I will and bequeath the rest and remainder of my lands and chattels to my four daughters Patience Gorman, Betsy ?? Elizabeth Furey, Anne Rourke and Mary Wade share and share alike; and in the event of their determining to sell and dispose of said lands and chattels I will and direct my Executors to ???tain out of the proceeds thereof the sum of Twenty Pounds and to pay the same for the offering up of masses for the repose my sould (sic) and that of my beloved wife - I will and direct that my wife shall be supported and maintained by my said son and impose as a further charge on him and my lands the payment to her during her life only the sum of Eight Pounds in the event of her not being satisfied with the said support she may sell and dispose of my cattle or stock now on my lands which she may determine on - I appoint the Reverend Patrick ODonnell CC and Richard McDonnell of Harbor Main Executors hereof. To the Honorable The Supreme Court of Newfoundland or any one of the Honorable The Judges thereof The Petition of Anne Rourke of Holyrood in Conception Bay Married Woman Humbly Sheweth That Edward Flaherty died there on or about the ninth day of January Anno Domini 1886 having made and executed his last will and testament as hereto annexed and which will has been duly proved in Written form that his wife died before him. That he left him surviving one son James Flaherty since the deceased ???ng his widow Agnes him surviving. That Anne the wife of said James died about five years ago in the lifetime of the said Testator and the said James subsequently married the said Agnes. That the daughter of the said Testator are still living and resident in Conception Bay aforesaid. That the grand daughter of said Testator in the said will named Patience is still living. That said Testator died possessed of property situate within the Jurisdiction of this honourable Court of the probable value of about fourteen hundred dollars. That in and ??? said last will and Testament he nominated and appointed the Reverend Patrick ODonnell of Conception Harbor in Conception Bay Roman Catholic priest and Richard MacDonald of Harbor Main in the same bay as executor thereof. That both of the said executors have duly renounced the said executorship as appears by the papers hereto annexed and signed by them. That as appears by the paper writing hereto annexed marked A and signed by them namely Mary Wade Elizabeth Furey and Patience Gorman all of Holyrood aforesaid thereof the daughters of the said Testator they have consented and agreed and do consent and agree that administration with the said Will annexed to the estate of the said Testator be granted to your petitioner. That your petitioner is willing to accept the office and duty of such administration. That no probate of the said will or administrator of the Estate of the said Testator has been hitherto granted. Petitioner therefore prays that administration of the estate and effects of the said Testator with the said Will annexed may be granted unto him and as in duty bound he will ever pray. SUPREME COURT OF NEWFOUNDLAND Be it Remembered That on this 2nd day of January in the fifty first Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-eight personally appeared Anne Rourke of Holyrood, Conception Bay the wife of Patrick Rourke same place farmer Michael Rourke of same place planter and John ONeil of same place farmer and Patrick Rourke of same place husband of the said Anne Rourke and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of three thousand Dollars to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :--- Now the Condition of this Obligation is such, that if the above bounden Anne Rourke as Administratrix C.T.A. of the Estate and Effects of Edward Flaherty late of Gasters planter deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Administratrix as such Administratrix C.T.A. or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the second day of August next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Anne Rourke or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the second day of February which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-eight and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
