ST. JOHN'S          }
To Wit                   }

Samuel I. Boone of St. Johns aforesaid Store Keeper maketh oath and saith that on the twenty seventh day of July A.D. one thousand eight hundred and eighty three at St. Johns aforesaid he this deponent was present and did see Christiana Down late of St. Johns the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for her last Will and Testament in the presence of this Deponent and of Solomon Butler the other subscribing witness thereto, That Deponent and said Solomon Butler then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Know all Men by these presents that I Christiana Down do hereby will and bequeath to my husband Robert Walter Down Master Boot and Shoe Maker of Saint Johns Newfoundland
Item First: A Dwelling House and Ground and Garden situated near the Barking Kettle bounded on the north west by Newman & Cox Meadow on the South East by New Gower Street Also I will and bequeath to Robert Walter Down aforesaid Item second My interest being the one sixth part of Four Tenements adjoining West of the aforesaid property. Also I will and bequeath to Robert Walter Down aforesaid Item Third My interest in the Dwelling House, Yardage and water privileges at present occupied by the said Robert Walter Down during the unexpired term of Lease also I will and bequeath to Robert Walter Down aforesaid Item Fourth my interest in the premises now occupied by Messrs William Hounsell & Co. Also I will and bequeath to Robert Walter Down aforesaid Item Fifth My interest

over

in a Dwelling House and Ground now occupied by Eugene Mcarthy situated near Custom House Hill also I will and bequeath to my Son Samuel Down Item Sixth my share of my mothers Houshold Furniture at Bread and Cheese Cove in Bay Bulls Harbour for his own especial use and benefit.

The Petition of Robert Walter Down of St. Johns in the Island of Newfoundland Shoemaker

Humbly Sheweth

That your Petitioners Wife Catherine orherwise Christiana Down died at St. John's aforesaid on or about the thirty first day of December in the Year of our Lord one thousand eight hundred and eighty four leaving her Surviving Your Petitioner and two children
That said Catherine otherwise Christiana Down was at the time of her death possessed in her own right of certain landed property within the jurisdiction of this Honorable Court of the probable value of Eight Hundred Dollars.
That the paper writing hereto annexed in the last will and testament of the said Catherine otherwise Christiana Down and which has been proven in due form of law by the affidavit of Samuel J Boone and of the Subscribing Witnesses thereto

 

That no executor has been appointed under said will and that as yet neither Probate or administration has been granted to said Estate
Your Petitioner therefore prays that Letters of administration with Will annexed to the said Estate may be granted to him
And as in duty bound he will ever pray

Be it Remembered That on this 14th day of June in the 51st Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-eight personally appeared Robert Walter Down of Saint John's in the Central District Shoe-maker Charles Hutchings of same place Sail-maker and John Scott of same place Builder and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of one thousand seven hundred Dollars, to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Robert Walter Down as Administrator C.T.A. of the Estate and Effects of Catherine otherwise Christiana Down late of St. John's married woman deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Robert Walter Down as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 14th day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Robert Walter Down or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 14th day of June which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

JOHN'S  } I do swear that I believe that Catherine otherwise To Wit           } Christiana Down late of St. John's aforesaid married woman deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of  my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which she died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight hundred and fifty dollars.
