AFFIDAVIT

You shall swear that you believe this to be the true Last Will and Testament of Margaret Dooley late of Saint John's in the Central District of Newfoundland, Widow, deceased

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Margaret Dooley Deceased, and of which she died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of seven hundred dollars.

To the honorable the Supreme Court or one of the Honorable Judges thereof

The Petition of James Dooley of St. Johns in the Island of Newfoundland, Shipwright.

Humbly Sheweth as follows

That Margaret Dooley formerly of St. Johns aforesaid Widow died on or about the Third day of March last past having first made and Executed her last will and testament hereto annexed proven upon the affidavit of Minnie E Dooley one of the subscribing witnesses thereto.
That in and by her said last will and testament the said deceased nominated and appointed your Petitioner Executor.
That at the time of her death the said deceased was possessed of property within the jurisdiction of this Honorable Court of the probable value of six hundred dollars.
That no probate or administration to her estate has been hereunto granted.
Petitioner there prays that probate to the said Will may be granted to him as Executor hereof and as in duty bound will ever pray &c &c

SUPREME COURT OF NEWFOUNDLAND

TO WIT    }

Minnie E Dooley of St. John's in the Island of Newfoundland maketh oath and saith that on the second day of March A.D. One Thousand Eight Hundred and Eighty-Eight at St. Johns aforesaid, she, this Deponent, was present and did see Margaret Dooley late of St. John's Widow the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of John Maher and Andrew O'Connor the other subscribing witnesses thereto. That Deponent and said John Maher and Andrew O'Connor signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other. That previously to the said Will being so signed as aforesaid, by the said Testatrix and the said witnesses, it was read over to and approved of by the said Testatrix in the presence of Deponent and the said John Maher and Andrew O'Connor and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The last Will and Testament of Margaret Dooley Widow of the late John Dooley of St. Johns in the Island of Newfoundland Shipwright. Revoking all other Wills and testaments, and after the payment of all my just debts and funeral expenses, I give and bequeath to my Son James Dooley all and Singular my Estate and effects, comprising my Two Dwelling Houses Situate on the West Side of Prescott Street in the Town of St. Johns aforesaid and adjoining the property of Mr. William Dooley, and also all my personal effects whatsoever to dispose of the whole of my Estate and effects as he may think fit and proper. I appoint my said Son James Dooley my Sole Executor to this my last Will and testament, directing him at the Same time to pay to the Rev'd P Delaney the sum of Twenty Dollars for Masses for the repose of My Soul.
In Witness whereof I do hereby subscribe my hand at St. Johns aforesaid this Second Day of March Eighteen hundred and Eighty Eight.
