The Petition of William Clapp of St. Johns in the Island of Newfoundland, Barrister at Law

Humbly Showeth

          That William Clapp of the City of Exeter in the County of Devon, England, Surgeon and F.R.C.S. of London, died on or about the twenty seventh day of May last having previously made and published his last will and testament and subsequently executed a Codicil thereto which said last will and Codicil are hereunto annexed, and appointed William John Clapp and George Tucker Clapp Executors thereof.
          That by Power of Attorney hereto annexed marked A from the Executors aforesaid your Petitioner has been appointed to apply to your Honourable Court for Letters of Administration Cum Testamento Annexo to the Estate of the said William Clapp, deceased.
          That at the time of his decease the said William Clapp was possessed of certain property within the jurisdiction of your Honourable Court of the probable value of thirty six thousand and six hundred dollars.
          That

          That no Probate of the said will and Codicil or Administration of the said Estate have been granted by your Honourable Court.
          Your Petitioner therefore humbly prays that Letters of Administration cum testamento annexo to the Estate of the said late William Clapp be granted to your Petitioner and as in duty bound will pray.

To all to whom these presents shall come We William John Clapp of Sidbury in the County of Devon in England Clerk in Holy Orders and George Tucker Clapp of Exeter in England Surgeon, Executors of the last Will and Testament of William Clapp late of Number 14 West Southernhay of Exeter aforesaid Surgeon, who died on the twentyseventh day of May One thousand eight hundred and eighty eight which will bears date the seventeenth day of February One thousand eight hundred and eighty six and with a Codicil thereto bearing date the fourteenth day of January One thousand eight hundred and eighty eight was proved by the said Executors in the Exeter District Registry of the Probate Division of Her Majesty's High Court of Justice on the fourteenth day of August One thousand eight hundred and eighty eight send greeting Know ye that we the said William John Clapp and George Tucker Clapp as such executors as aforesaid Do hereby make ordain constitute and appoint William Clapp of Saint Johns in the Island of Newfoundland, Barrister-at-law and Solicitor, for us and in our names and on our behalf to prove the said last Will and Testament and Codicil thereto of the said William Clapp deceased in the Supreme Court of Newfoundland or in any Court or Courts in the said Island of Newfoundland having Jurisdiction in or power or authority in the said matter. And as our true and lawful attorney and for us and our behalf to obtain power to administer all and singular the goods chattels credits and effects of the said deceased within the said Island of Newfoundland and its dependencies and generally for us and in our names to do and perform and cause to be done and performed all and whatsoever shall be needful and requisite for the programs herein expressed as freely and effectually as we could or might do if personally present, we hereby agreeing to ratify and confirm all and whatsoever our said attorney shall lawfully do or cause to be done in the premises by virtue of these presents. In witness whereof we the said William John Clapp and George Tucker Clapp have hereunto respectively set our hands and seals this twenty second day of November One thousand eight hundred and eighty eight

To all to whom these Presents shall come I Arthur Burch Notary Public duly authorized admitted and sworn residing and practicing in the City of Exeter in England do hereby certify that I was present on the twenty second day of November one thousand eight hundred and eighty eight and did see William John Clapp and George Tucker Clapp the persons named in the foregoing paper writing or power of attorney respectively duly sign seal and execute the same and that the names "William John Clapp" and "George Tucker Clapp" respectively thereto subscribed are respectively of the proper handwriting of the said William John Clapp and George Tucker Clapp and that the names "Edw'd Petherick" and "Horace R Burch" respectively thereto ----- subscribed as the witnesses thereto are of the respective proper handwriting of
Edward Petherick and Horace Ralph Burch both of the City of Exeter aforesaid solicitors the subscribing witnesses thereto. In testimony whereof I have hereunto subscribed my name and affixed my seal of office this twenty second day of November in the year of our Lord one thousand eight hundred and eighty eight.

Be it Remembered That on this Twenty second----- day of December in the fifty second Year of the Reign of our Soverign Lady Victoria by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Eighty Eight personally appeared William Clapp of St. Johns in the Central District of Newfoundland, Barrister at Law ----- and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Seventy four thousand ----- Dollars, to be had, made and levied on their Good, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:

Now the Conditions of the Obligation is such, that if the above bounden William Clapp----- or administrator e.ca. of the Estate and Effects of William Clapp----- late of Exeter in the County of Devon England Surgeon----- deceased, do make, or cause to be made, a Just, true, and perfect inventory of all and singular the Goods, Credits, and Effects of the said deceased which have or shall come to the hands, possession, or knowledge of him the said William Clapp----- and such Administrator or to the hands or possession of any other person or persons, for him and the same so made do exhibit or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 22nd day of June next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said William Clapp -----
or to the hands or possession of any other person or persons for      shall well and truly administer according to law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 22nd day of December which will be in the Year of our Lord One Thousand Eight Hundred and Eighty Nine and afterwards from time to time as he ----- shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force virtue.

          Be it known that upon search being made in the District Registry attached to the Probate Division of Her Majesty's High Court of Justice at Exeter it appears that on the fourteenth day of August 1888 the last will and Testament with a Codicil thereto of William Clapp late of No 14 West Southernhay in the County of the City of Exeter, Surgeon, deceased, who died on the twenty seventh day of May 1888 at No 14 West Southernhay aforesaid and had at the time of his death a fixed place of abode at Exeter within the District of the County of Devon was proved by the Reverend William John Clapp of Sedford in the County of Devon, Clerk, and George Tucker Clapp of the City of Exeter, Surgeon, Sons of the deceased his Executors named in the said Will and which probate now remains of record in the said District Registry. The true tenor of the said Will and Codicil is in the words following. To wit,
In humble thankfulness to Almighty God for all his mercies I William Clapp of West Southernhay, Exeter, hereby declare this to be my last Will and Testament. I give and devise all that my dwellinghouse in which I now reside situate and being in 14 West Southernhay, Exeter, and also that my freehold field situate in the Parish of West Teignmouth, Devon called Coombepark to my son George Tucker Clapp his heirs executors administrators and assigns. I give and bequeath to him also all my shares of certain monies in the Consolidated Annuities of the Bank of England bequeathed to me by my sister Mary Frances Bulley Clapp after the decease of my sister Caroline Clapp, and also all my furniture, linen, pictures, books and other household effects in my said dwellinghouse except my plate which I give as hereafter mentioned. I give devise and bequeath all that part of my property situated in Saint Johns, Newfoundland, consisting of lands and buildings which formerly belonged to my cousin Cady? Tonk?? and also all my fields and closes of land with the erections thereon called or known as Margetta Parks situate in Parish of West Teignmouth in the County of Devon unto and equally between my sons John Tucker Clapp and Cecil Robert Mainevaring Clapp their heirs executors administrators and assigns together with all rents which may be due from the said properties from the date of the last payment. I give devise and bequeath all that my part or other property in Saint John's, Newfoundland, consisting of lands and buildings which formerly belonged to my father unto my son Francis Chapman Clapp his heirs executors administrators and assigns. I give all my plate to be equally divided between my sons William John Clapp, Cecil Robert Mainevaring Clapp and Francis Chapman Clapp. I give to my dear sister Caroline Clapp the sum of Ten guineas as a remembrance of her kindness to me          All the rest residue and remainder of my property estate and effects after payment of my debts and funeral and testamentary expenses I give devise and bequeath to my son William John Clapp. I devise all Estates vested in me as trustee or mortgage to my sons William John Clapp and GeorgeTucker Clapp subject to the equities affecting the same respectively and I appoint my said sons William John Clapp and George Tucker Clapp Executors of this my Will, In witness whereof I have hereunto set my hand this seventeenth day of February one thousand eight hundred and eighty six ----- William Clapp----- Signed by the said William Clapp and declared by him to be his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of one another have hereunto subscribed our names as witnesses----- William Heathman Parkhouse Rector of St. Paul's, Exeter ----- Mary Spence Parkhouse,wife of the above -----
This is a Codicil to the Will of me William Clapp Will bears date the seventeenth day of February On thousand eight hundred and eighty six. I hereby revoke the devise contained in my Will of all that my part of the property in Saint Johns, Newfoundland, consisting of lands and buildings which formerly belonged to my father to my son Frances Chapman Clapp his heirs executors administrators and assigns and in place and stead thereof I give devise the same hereditaments and premises and also the sum of nine hundred and seventy two pounds Government n?? 27 per cents now standing in the names of me the said William Clapp and my sons William John Clapp and George Tucker Clapp (subject to my sister Caroline's life interest) to my sons John Tucker Clapp and Cecil Robert Mainevaring Clapp their heirs executors administrators and assigns Upon trust to receive the annual rents and income thereof and (after payment ho??ut of all costs and expenses and necessary deductions) to pay the same income half yearly to my dear son Francis Chapman Clapp for and during his life or until he shall by his own act or operation of law forfeit lose or in any way attempt to anticipate or part with the said income or any part thereof then on the happening of any such event or on his decease whichever shall first happen then Upon trust for the children of my said son Francis Chapman Clapp equally between them if more than one or if any one of them should have died leaving issue then such issue shall take his or her parent's share equally between them if more than one but in case my said son Francis Chapman Clapp shall die without issue then I give and devise the same hereditaments and premises including the said sum of nine hundred and seventy two pounds to my said sons John Tucker Clapp and Cecil Robert Mainevaring Clapp their heirs executors administrators and assigns absolutely equally between them share and share alike. And in all other respects I confirm my said Will. In witness whereof I have hereto and to the preceeding sheet set my hand this fourteenth day of January One thousand eight hundred and eighty eight----- William Clapp----- Signed by the said William Clapp in the presence of us present together at the same time and who in his presence and in the presence of each other have hereunto set our names as witnesses----- John W Petherick Sol Exet----- Edw'd Petherick, Solicitor Exeter-----
