ST. JOHN'S,    )     I do swear that I believe that John Squarey Clapp late of
to Wit               )     Teignmouth in the County of Devon England, gentleman ----------
deceased, died with ----- a Will, and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, as far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgement and belief, amount to the value of Eighty thousand ----- dollars.

Be it Remembered That on this nineteenth                day of January
(signature initials)      in the 51st Year of the Reign of our Sovereign Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-Eight personally appeared Gilbert Clapp of Saint John's in the Central District of Newfoundland, Gentleman-----
(signature initials)         and did acknowledge himself to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of

One hundred and sixty thousand Dollars to be had, made and levied on his Goods, Chattels and Effects, if Default is made in any of the conditions following:-----

Now the Conditions of this Obligation is such, that if the above bounden Gilbert Clapp as Administrator C.Ca of the Estate and Effects of John Squarey Clapp late of Teignmouth, Devon, England deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Gilbert Clapp ----- and such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the nineteenth day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands of possession of him the said Gilbert Clapp or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the nineteenth day of January which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-nine and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Humbly Showeth

That your petitioner's late brother John Squarey Clapp late of Teignmouth County Devon England gentleman discarded this life on or abour the thirteenth day of November AD Eighteen hundred and eighty having Greviously made and Published his last will and testament exemplification of probate whereof is hereto annexed
That by his said will the said late John Squarey Clapp appointed his niece Mary Bulley Clapp sole Executrix thereof.
That by power of attorney hereto annexed the said Executrix nominated and appointed your petitioner to apply for and take out in Newfoundland letters of administration.

 

Administration cum testamento annexo of the Estate in Newfoundland of the said late John Squarey Clapp. That the said John Squarey Clapp left him surviving.
That at the time of his decease the Estate of the said late John Squarey Clapp in this Colony did not exceed the sum of Seventy five thousand five hundred dollars in value.
That no administration of said Estate in Newfoundland hath been granted by your Honourable Court.
Your petitioner therefore humbly prays that Letters of Administration of the Estate in Newfoundland of the said late John Squarey Clapp may be granted to him (cum Testamento annexo) and as in duty bound will pray.

This is the last will and Testament of Mr. John Squarey Clapp of Teignmouth in the County of Devon Gentleman I appoint my niece Mary Bulley Clapp to be sole Executrix of my will. I give devise and bequeath unto my said Niece Mary Bulley Clapp absolutely her heirs executors administration and assigns all my share and shares estate and interest whatsoever in the pieces plots and parcels of land with the several dwelling houses shops stores warehouses wharves cellars platforms and buildings thereon situate in Water Street and Duckworth Street in St. Johns in the Island of Newfoundland to which I am Entitled under and by virtue of the will of my late Father bearing date on or about the thirteenth day of May One thousand Eight hundred and forty seven and a Conveyance from my brother Robert Clapp bearing date on or about the thirty first day of July one thousand Eight hundred and forty two I give and ??? that ??? Dwelling house far??? hereditaments and premises situate in Ieip? Street in the parish? Weal? Teignmouth in the County of Devon now in my own occupation with the appurtenances unto my said Niece Mary Bulley Clapp her heirs and assayers for ever. I give and bequeath all my household furniture plate linen china glass books, presents pictures and all other household effects of which I shall die possessed unto my said niece Mary Bulley Clapp absolutely. I give devise and bequeath all the above and interest whatsoever of and in the dwelling houses hofo? warehouses wharves cellars platforms buildings hereditaments and premises situate in St. John's in the Island of Newfoundland aforesaid to what I am entitled under and by virtue of the will of my late sister Mary Bulley Clapp unto my Brother Gilbert Clapp his heirs executors----- administrators and assayers And if my said Brother Gilbert Clapp shall die in my lifetime then I give devise and bequeath the same hereditaments and premises unto such of the children of my said Brother Gilbert Clapp as shall be living at the time of my decease in equal shares as tenants in common their respective heirs executors administrators and assayers If we and devise and bequeath to my said heir Mary Bulley Clapp a yearly rent charge of one hundred and forty pounds ??? ??? for her life to be charged upon and iss??? out of my dwelling house shops warehouse, wharves, cellars platforms buildings hereditaments and premises situated Saint John's in the Island of Newfoundland and not herein- before devised and hereinafter more particularly described and or repayable half-yearly without deduction and the first payment of the said yearly rent charge of one hundred and forty pounds sterling to be made at the end of six Calendar months Computed from my decease and a proportionate part of such yearly rent charge is to be paid up to the determination thereof And I --- Empower my said Niece Mary Bulley Clapp by dispen? and also by Entry upon and perception of the rent, and propts? (left margin writing missing) ???f my said dwelling house shop warehouse wharves cellers platforms buildings heriditaments a???(small missing page section) to recover payment of the said rent charge when in arrears for twenty five days. I give devise and bequeath all and any aforesaid dwelling houses Shops warehouses Wharves Cellars Platforms buildings hereditaments and premises situate in Water Street in Saint Johns in the Island of Newfoundland aforesaid not hereinbefore devised and bequeathed and which said hereditaments and premises were leased to John Butler Barnes in or about the year one thousand eight hundred and forty nine for a term of forty years and are now at the P??? of the Savings Bank as tenants thereof but subject to the said rent charge of one hundred and forty pounds sterling payable to my said Niece Mary Bulley Clapp during her life unto my said Brother Gilbert Clapp his heirs executors administrators and asigns and if my said Brother Gilbert Clapp shall die in my lifetime then I devise and bequeath the same Dwelling house Shops, Warehouse, wharves Cellars Platforms Buildings hereditaments and premises unto such of the children of my said Brother Gilbert Clapp as shall be living at the time of my decease in equal shares as tenants in common ??? ??fective heirs executors administrators and assigns I give and devise all that ??? Dwelling house Garden hereditaments and premises situate in ?eipe Street in the said parish of West Teignmouth now in the occupation of William John B???ts Banking as tenants thereof with the appurtenances unto my Niece Margaret Clapp her heirs and assigns forever. I give and bequeath to my said Niece Margaret Clapp all and singular the monies in the public stocks funds or government securities of Great Britain to which I am entitled under or by virtue of the will of my deceased sister Mary Frances Bulley Clapp. I bequeath the pecuniary legacies following namely to each of the sons of my Brother William Clapp who shall be living at the time of my decease a legacy of one hundred pounds sterling and to my servant Resia? Johns (missing portion of page) shall be in my service at the time of my decease a legacy of Fifty pounds sterling And I direct the said legacies to be paid within six Calendar months ??? after my decease. I give and bequeath the residue of all the real and personal estate of whatsoever description and wheresoever situate to which I shall be entitled at the time of my decease unto my said niece Mary Bulley Clapp absolutely her heirs executors administrators and assigns. I direct that the shares estates and interests of such of my said nieces as shall be married women shall be received enjoyed and disposed of by them as their separate property free from marital control and that their respective receipts alone ----notwithstanding coverture shall be effectual discharge I devise all real estate (if any) vested in me a ???ter of ???e to my said niece Mary Bulley Clapp her heirs and assigns subject to the equitier? affecting the same respectively. Lastly I revoke all other wills. In witness whereof I have hereunto set my hand and I have also set my hand to each of the two preceding sheets of this my will this fifth day of October in the year of our Lord one thousand eight hundred and eighty John Squarey Clapp, Signed by the ??? ??? of atn?
