You shall swear that you believe this to be the true last Will and Testament of Johannah Cash late of Saint Johns in the Central District of Newfoundland, Spinster, deceased

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Johannah Cash deceased, and of which she died possessed, do not, according to the best of your knowledge, judgement and belief, amount to the value of two thousand ____ dollars.

So help you God.

After three days application will be made to the Supreme Court of the Honorable Judges ??? Probate of the will of Johannah Cash, late of Saint Johns Spinster ??? to be granted to John Sullivan Sup? Inspector of Police, then Executor therein named (Legal stamp & seal of Registrar's Office)

Nicholas Grace of St.. John's aforesaid shoemaker maketh oath and saith that on the seventh day of November A.D. one thousand eight hundred and eighty seven at St. Johns aforesaid ___ he this deponent was present and did see Johannah Cash            late of St. Johns spinster the Testator named in the paper writing hereto annexed, duly sign publish and declare the said annexed paper writing as and for her last Will and Testament in the presence of this Deponent and of Catherine Senior the other subscribing witness thereto. That Deponent and said Catherine Senior then and there signed their names to such Will and such witness in the presence of the said Testator and of each other.

 

and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

          I Johannah Cash of St. Johns spinster do make this my last will and testament.
1st after the payment of all my just debts and funeral Expenses I give and bequeath to the Revd William Forrestor? the sum of three pounds for Masses for the repose of my soul. To the Revd John Scott the sum of three pounds To the Revd John Ryan the sum of three pounds and to the Revd Michael Morris the sum of three pounds for the same purpose and to His? Lordship ?r? Power? a sum sufficient for one High Mass for the repose of my soul.
Second, I give and bequeath for the use of the orphans of Villa Nova the sum of five pounds and a like sum to the orphans of St. Michaels Belvedere

Third I will and bequeath to my Brother Edward now living at Halifax N.S. the sum of forty pounds and to my Nephew Edward Cash son of my Brother Edward the sum of forty pounds. To my Sister Ann? Fahy? now living at Boston Mass the sum of forty pounds. To my sister Mary now living at Halifax N.S. the sum of twenty pounds.
To my two nieces Johanna and Annie

Annie Cash daughters of my Brother Edward the sum of twenty pounds Each and to my niece Mary baby daughter of my Sister Ann the Sum of twenty pounds. To my niece Margaret Cash who now lives with me the sum of twenty thirty pounds,
And I appoint John Sullivan of St. Johns Sup? Inspector of Police my Sole Executor

To the Honorable Sir F.B.T.Carter Chief Justice of the Supreme Court of Newfoundland or one of the Honorable Assistant Judges thereof. _____

The petition of John Sullivan of Saint Johns sup Inspector of the Newfoundland Constabulary.

Humbly Showeth

That Johanna Cash late of St. Johns aforesaid Spinster died on or about the twenty seventh day of April last past having duly made and executed her last Will and Testament, which has been duly proved and hereto annexed. _____
That under the said Will your Petitioner was appointed sole Executor.
That the said Johanna Cash was possessed of property within the jurisdiction of said Supreme Court, of the probable value of Eighteen hundred dollars.
That no Administration or Probate has been granted to said Johanna Cash's Estate.
Your petitioner therefore prays that one of your Lordships will be pleased to intrust him with Probate of the Will of said Johanna Cash _____
And as in duty bound will ever pray
