AFFIDAVIT.

You shall swear that you believe this to be the true Last Will and Testament of John Grahamlate of St. Johns in the Central District of Newfoundland Master - Mariner -    deceased    ---------------------

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you ; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of New-foundland, when you shall be lawfully called thereto:   And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Graham           deceased, and of which          he          died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of four hundred and fifty -------------------- Dollars

So help you God.

After three days application will be made to the Honorable the Supreme Court or one of the Honorable Judges thereof for Probate of the will of the late John Graham Master Mariner deceased of Saint John's to be granted to Alexander Graham Executor under the said Will .

I hereby certify that the notice on the other side hereof written was duly posted in my office on the day of the date thereof and has remained there until this day no caveat or other objection having been entered thereto in the meantime .

TO WIT }

          Hugh H. Carter ---------------- of    St Johns aforesaid, Barrister at Law maketh oath and saith that on this thirteenth day of November A.D. one thousand eight hundred and eighty   five          at   St John's       ------------ he, this Deponent, was present and did see     John Graham          late of St John's Master. Mariner       the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of  Thomas W. Spry ---------- the other subscribing witness thereto. That Deponent and said Thomas W. Spry          then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

This is the last Will and Testament of me John Graham of Saint John's in the Island of Newfoundland Master Mariner - I give devise and bequeath all my real and personal Estate of every description unto my son John McCallum Graham for himself and for the support of his mother and my wife Ann_ Graham during her life time and while she remains unmarried and also for the support of my daughter Martha until she marries. And I hereby appoint my brother Alexander Graham sole Executor of this my last Will and Testment. In Witness whereof I hereunto set my hand this thirteenth day of November Anno Domini one __ thousand eight hundred and eighty five .

To the Honorable the
Supreme Court or one of
the Honorable Judges
thereof.

The Petition of Alexander Graham of St. John's Master Mariner

humbly sheweth

          That John Graham of Saint John's aforesaid Master Mariner died there on the sixteenth day of March last having previously made and executed his last Will and Testament (hereto annexed).
          That deceased left him surviving his widow Ann Graham one son, a minor, John McCallum Graham who is nineteen year of age Legatee under the said Will and three daughters viz, Constance married to Daniel Currie residing in St John's aforesaid Christina married to George Nutell? residing in the Dominion of Canada and Martha unmarried residing in ST. John's aforesaid
          That your petitioner was appointed by the said will sole executor thereof.
          That at the time of the Testator's decease he was possessed of property of the probable value of four hundred dollars.
          That the said will has been proved in common form.
          That neither Probate nor

administration has been granted previously.
          Petitioner therefore prays that your Lordship will be pleased to grant him probate of the said will.
          And as in duty bound will ever pray.
