AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Magdalene Evans late of Channel in the Southern District Widow
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as
the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full,
and perfect Inventory of all and every the Goods, Rights and Credits of the deceased,
together with a just and true account into the Registry of the Supreme Court of New-foundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Magdalene Evans deceased, and of which she died possessed,
do not, according to the best of your knowledge, judgment and belief, amount to the
value of fifteen hundred ----------------Dollars

In the name of God Amen.
I Magdalene Evans widow of John Evans of Channel in the Southern District
of Newfoundland being very sick and weak
of body but of perfect mind and memory
thanks be givens to God calling unto mind
the mortality of my body and knowing that it
is appointed for all men once to die do make
and ordain this my last will and testament
towards my family that is to say principally
and first of all I give and recommend my
soul to God who gave it and my body to be
buried in decent Christian burial at the
discretion of my executor.
I give and bequeath to my son Edwin Joseph Evans my dwelling house with
the furniture belonging to it (save and except
the furniture and all other articles contained
in my bed-room at the time of my death. Viz two gardens three stores wharf stage
together with the land belonging thereto.
I give and bequeath to my grand daughter Susannah Clarisa Forsey all the articles

contained in my bedroom at the time of
my death viz one bed one bedstead bedding
one washstand one table one looking glass
two trunks three chairs my cloathing ???ments and whatever else is found therein
I give and bequeath to my daughter Ann Matthews one chest of drawers.
I give and bequeath to my daughter Magdalene Forsey one vase of flowers that
now stand upon the parlor table.
I also give to my daughter Ann Matthews a water side premises on the southern side
of the road leading to the wharf and running
N. W. by N. 62 feet. Commencing at the Northern gulch
I give to each of my two daughters viz Ann Matthews and Magdalene Forsey a piece
of land connected with my property at
Channel and for which they have grants
from Government specifying their bounds.
I also direct the dwelling house and
premises occupied by Emmanuel Matthews be given up to and possessed by Joseph ??? Evans the bounds of which to extend from gulch to gulch

I direct further that in no case whatsoever
is my son Edwin Joseph Evans to sell his
share or interest in the property herein divided?
unless it be to one or all of my children.
And finally should my son Edwin Joseph Evans die and his widow marry again she
shall forfit and lose all right to the claim
or interest in and to any part or portion of my
property that may remain at my death and
in such case the share or interest of the pro-perty of the aforesaid Edwin Joseph Evans my
son shall be equally divided amongst his
surviving children.
And of this my last will and testament
I appoint my son Edwin Joseph Evans my
Executor hereby revoking all other former
wills I declare this only to be my last will
and testament.
In witness whereof I have hereunto
set my seal and hand at Channel in the
Suthern District of Newfoundland on
this the sixth day of January In the year
of our Lord one thousand Eight hundred

The Reverend William H. Edy?ean of Channel in the Southern District Wesleyan Minister
maketh oath and saith that on the Sixth day of January
A. D. one thousand eight hundred and eighty seven at Channel
aforesaid he, this Deponent, was present and did see Magdalene Evans late of Channel aforesaid Widow the Testatrix named in the paper writing hereunto annexed
duly sign (by making her mark) publish and declare the said annexed paper writing
as and for her last Will and Testament, in the presence of this Deponent
and of George W. Bragg of Channel aforesaid

the other subscribing witness thereto. That Deponent and said George W. Bragg then signed their names to each Will as such witnesses, in the presence of the
said Testatrix and of each other - That previously to the said Will being so signed
as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and
approved of by the said Testatrix in the presence of Deponent and the said George W. Bragg and that at the time of the said execution of the said Will the said Testatrix was
of sound and disposing mind, memory and understanding, to the best of Deponent's
knowledge and belief.

Channel in the Southern District
Fisherman
Humbly Sheweth
That Magdalene Evans late of
Channel aforesaid Widow deceased
(mother of petitioner) died at Channel
aforesaid on the tenth day of
March last, leaving previously made
her last Will and testament which is
hereto annexed and of which she
appointed your petitioner Sole Executor.
That said deceased at the time of
her death was possessed of property
of the probable value of Fourteen hun-dred dollars -
That no probate of any will
nor administration of the Estate of said
deceased has been granted to any person
Petitioner therefore prays that
Probate of the said Will may be granted
to him. And as in duty bound he
will ever pray &c St Johns April 11.1887.
