AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of

Catherine Doheney late of St John's in the Central District
    widow ,     deceased

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of New-foundland, when you shall be lawfully called thereto:    And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Catherine Doheney deceased, and of which          she          died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of     six hundred & fifty          Dollars.

 

So help you God.

I Catherine Doheney Widow of the late Edward Doheney in the Island of Newfoundland Do make publish and declare this to be my last will and testament and I hereby revoke all former wills codicils and testamen s whatsoever .        My Will is first that my funeral expenses and all just Debts be paid and the residual and remainder of my real and personal property which shall bot be required for such pur-poses I give, devise bequeath and dispose thereof as follows ? ??
          I bequeath to my Daughter Mary (wife of Thomas Howlett) free from the control of her present husband or any future one. The dwelling house and shop with yard attached now i? my be??- p?in?y being No 1?7 Gower Street for the term of her natural life and after her Death the Rent accruing from said proerpty I give and bequeath to the Roman Catholic Bishop of St Johns to be applied for masses for the Repose of the Souls of my Self and family
          To my son Michael I Give and bequeath the House No 86 Gower Street purchased by                                                                       me.

from Mr. William Gallivan _ on this condition that my Said Son withdraws f?? ??i? and continues a total abstaince, otherwise I devise and bequeath the Said House to my Daughter Mary (Mrs Howlett)
          I hereby ?a?? and direct that the sum of Twenty four Dollars be paid to the Revd Father John Ryan for masses for the repose of my soul and the soul of my late daughter Bridget Peyon?
          I also give and bequeath to my Daughter Mary (Mrs Howlett) all my houise hold furniture, goods chattels and effects, directing her to sell and dispose of my Bed, and apply the proceeds for masses for the repose of the Souls of myself and my husband.
          I hereby nominate and appoint my Daughter Mary (Mrs Howlett) my sole Executrix of this my last will and testament

That your petitioner's late mother Catherine Doheney late of St. Johns aforesaid, Widow, departed this life on the ninth day of No - vember last, having previously made her last will and testa - ment hereto annexed of which she appointed your Petitioner sole Executrix .
     That at the time of her decease the said CatherineDoheney was possessed of

     That no Letters of Administration have been granted to the Estate of the said Catherine Doheney .

The petition of Edward Doheny of Little Bay Northern District, Shoemaker

Humbly Sheweth.

          That his late Mother the late Catherine Doheny formerly of St Johns' Central District, Widow, died on the Ninth day of November last past having first made a last Will and testament as it is alleged. That at the time of her death there were living as her next of kin three sons namely James, Michael and your petitioner Edward, and four daughtrs namely Mary wife of Thomas Howlett, Ellen unmarried now residing in Boston in the United States of America, Teresa a nun ??? convent in Boston aforesaid, and Kate wife of Thomas Stevens also residing out of the Colony, and one grandchild the daughter of a deceased daughter of said Catherine Doheny, named Sarah, formerly wife of Thomas Comerford, said Comerford residing out of the Colony and the said grandchild with the said Mary Howlett. That the said petitioner had during many years given to his said Mother ??? sums of
Money which he understood would be placed safely for him, a?d??ting a? ??

??oa? Eight hundred Dollars. That he is desirous to have ??ed?ones adopted which will presume the Estate of the said Testator to respond to his claim.
    That in his opinion the granting of Probate of said Will to said Mary Howlett the executrix, named threin will nulitate against his ??? the husband of the said Mary Howlett living outside this Colony and the said Mary Howlett preparing so your petitioner is led to believe to go to him.
          Your petitioner therefore prays that Letters of Administration to said Estate then be granted to such, person as the Court may direct.
And for which as in duty bound he will Ever pray .

maketh oath and saith that on the    Seventh          day of February A. D. one thousand eight hundred and eighty six       at St Johns aforesaid    he, this Deponent, was present and did see Catherine Doheney                    late of St John's widow          the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her     last Will and Testament, in the presence of this Deponent and of     W . J Hollahan of St. Johns aforesaid Yeoman --------- the other subscribing witness - thereto. That Deponent and said   W .J .Hollohan ----------------- then signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other--That previously to the said Will being so signed as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by the said Testatrix in the presence of Deponent and the said   W .J. Hollohan    ------------------------- and that at the time of the said execution of the said Will the said Testat     was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
