                    in the ????          50th    Year of the Reign of our Sovereign
                    Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender pf the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven personally appeared Charles Burridge of Saint Johns in the Central District of the Island of Newfoundland Mason, Charles Barnes of same place Accountant, Alexander M. McKay of same place Superintendant of Telegraphs and John Angel of same place Machinist and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of      Thirteen thousand

Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and Severally, if Default is made in any of the conditions following :-

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden Charles Burridge and Charles Barnes      as Administrators C.T.A of the Estate and Effects of                    Thomas Burridge late of St Johns Master mason deceased, do make, or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased which have or shall come to the hands, possession , or knowledge of      them      the said Charles Burridge & Charles Barnes as such Administra               or to the hands or possession of any other person, or persons, for    them      and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the          15th      day of September next ensuing the date hereof ; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards Shall come into the hands or possession of them the said Charles Burridge & Charles Barnes or to the hands or possession of any other person or persons for          shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of their said Administration, on or before the        1?               day of March which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-Eight          and afterwards from time to time as they shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundlandland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct ; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

     The petition of Charles Burridge of St John's Newfoundland Mason and Charles Barnes of the same place accountant

Humbly sheweth

     That Thomas Burridge late of St Johns' aforesaid Master Mason died on or about the twentieth day of January last in st John's having first made and published his last will and testament hereto annexed whereof he appointed George M. Johnson of st John's barrister Executor .
     That the said George M Johnson has duly renounced executionship
     That the said Thomas Burridge left him surviving as next of kin the -following his children namely, your -petitioner Charles Burridge ,William Burridge his daughters by his first marriage Lucretia J .wife of your petitioner Charles Barnes and Mary Ann wife of Edward F Barnes and three children of his second marriage namely Charlotte Jane Burridge Thomas ??? Burridge and Fanny Jane Burridge which last named children are all under the age of Ten years.
     That hereto annexed is the content of the said Lucretia J. Barnes and of

 

 

Mary Ann Barnes that letters of adminis-tration of the estate of the said late Thomas Burridge cum testament annexo be granted to your petitioners.
     That the said william Burridge has not resided in Newfoundland for several years and ?? deponents are informed and believe now live in Australia .
     That the estate of the said Thomas Burridge deceased at the time of his death did not exceed the sum of ------ Six? thousand ------ dollars in value .
     That no probate of said will or letters of administration of the said estate of Thomas Burridge have been granted
     Your petitioners therefore humbly pray that letters of administration of the said estate of the said late Thomas Burridge cum tetstamento annexo be granted to them and as in duty bound will pray

Burridge of st John's Mason and to Charles J Barnes of st John's accountant husband of the subscriber Lucretia Barnes the next of kin of said Thomas Burridge being his sons Charles (above married) and William Burridge (now in Australia) and ?s ?? daughter of said Thomas Burridge he having also left ­him surviving three minor children na-med in his will.

This is the last will and testament of me Thomas Burridgeof st Johns master mason and I revoke all former wills by me made    I give devise and bequeath unto my executor hereinafter named all my property both real and personal whatsoever of which I shall ?? possessed in trust for the use of my children Charlotte Jane Burridege Thomas Hall Burridge and Fanny Jane Burridge in equal part and shares and I appoint George M. of St Johns Student at Law maketh oath and saith that on the twenty second day of October A.D. one thousand eight hundred and eighty six at Saint John's                         he, this Deponent, was present and did see   Thomas Burridge                              late of Saint John's          the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for     his   last Will and Testament, in the presence of this Deponent and of George M. Johnson of St Johns Barrister

the other subscribing witness    thereto. That Deponent and said George M. Johnson aforesaid

then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said George M. Johnson aforesaid

and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

          In this Estate one of the administrators Charles J. Barnes, has applied under the 19 S??: of Act 4.1 bic: C 11 ., for li?ue to purchase certain effects of the Estate on the grounds and for the reasons set out in his Petition, filed , of this date, for that purpose.
   Owing to the utmost total absence of any precident on record of such an application b??ing having been made under this si?:, to a Judge of the Court & under such circumstances as ??? in this Petition I consider it right

     The petition of Charles J. Barnes of St John's

Humbly sheweth

       That he is one of the two ad minis-trators of the Estate of Thomas Burridge late of st John's aforesaid master mason deceased   the co - administrator being Charles Burridge of st John's mason
       That an inventory of the estate of the said late Thomas Burridge is hereto annexed marked A .
       That by his will which was duly proved the said Thomas Burridge bequeathed all his estate for the benefit of his minor children who are all under the age of ten years and are at present and must for several years be supported under out of the said estate.
       That the said late Thomas Burridges business was conducted on premises situate in Hoyles town held under lease from one Bode?? Which leasehold interest is ??? held by the administrators.
       That there is now on said premises the residue of the stock of the said late Thomas Burridge which stock in trade had considerably run down or ??? before his decease owing to his illness
                                                 and

 

 

and other causes and said stock is not at present nor was at his death sufficient to continue the business without the same being added to with sorting up supplies.
       That this deponent and his co -ad_ministrator are desirous of selling by auction all the said leasehold and interest of the said estate therein and also the said stock in trade and such like chattels on the said premises or in anyway connected there with and he is desirous of bidding ,in his own name and behalf at such auction for such leasehold property and stock ??? goods and chattels or part of such goods and chattels and stock in trade and humbly prays that your Honour-able Court or a Judge will be pleased to permit him so to do on such terms and conditions ?? to notice of sale by pub-lic advertisement or otherwise as to the said Court or Judge will s??? meet and that on such bidding at auction such leasehold interest and such goods and chattels or stock in trade or part thereof may in case your petitioner shall be the highest bidder and pur-chaser may be the absolute property

In re Burridges Est.

               I have examined into the matter referred to me by the annexed ??le.
               It being the duty of the Id?in to realize the Estate I think he may be permitted to bid ???ly for that portion which he desires to purchase set forth in the exhibit A hereto annexed upon the following conditions .
        The personal chattels of property to be sold in detail and not in lots

        The Leasehold interest in the property at Hoyles Town to be sold by Public Auction and at a day and time distinct from the sales of the personal property.

        That a Public Notice of such sale containing full particulars of the place and time of such sales be published in two Daily newspapers for three weeks preceeding such sales . and stating in detail the property to be sold.

        The Sales of the personal property to be continued from day to day after sale has begun until all said property is sold notices being continued in the papers during and ?he?ing continuance of such sale.

        The Administrator Charles Barnes to have leave to bid at f? any and all the property named in Exhibit A but only after the last bid from the general public has been made.
