Notice

After three days application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Letters of Administration of the Estate of Robert Brown late of Saint Johns Engineer deceased to be granted to David Skirving of Saint Johns Engineer

The Petition of David Skirving of Saint John Engineer

Humbly Sheweth

          That Robert Brown late of Saint Johns Engineer died there on the twenty first day of May instant intestate.   That the said deceased left us relatives in this Island and his nearest of kin are his mother now ??? and ??? residing at Colinsburgh in FifeShire Scotland

          That said Robert Brown was at the Time of his death possessed of property In Newfoundland of the probable value of Thirteen hundred dollars
          That said deceased had been residing, with petitioner for nearly fourteen years previous to his death
          That no probate of any will an administration of the Estate of said deceased has been granted to any person

          Petitioner therefore prays that administration of the Estate of said deceased may be granted to him
             And as in duty bound he will ever pray &c

BE IT REMEMBERED, That on this       Eighteenth           day of     July                              in the ???      51st      Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Eighty- seven    personally appeared David Skirving of Saint John's in the Central District Engineer John Last of same place accountant and James Jardine of same place Government Clerk and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of     Two thousand Eight hundred---------------
Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and Severally, if Default is made in any of the conditions following:-

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden David          Skirving          as Adminis tor          of the Estate and Effects of            Robert Brown                    late of St John's Engineer deceased, do make, or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of       him          the said      David Skirving --------------------
as such Administra  tor          or to the hands or possession of any other person, or persons, for      him       and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the       18th           day of       January next ensuing the date hereof ; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said David Skirving          or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of    his      said Administration, on or before the          18th          day of     July
which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty- eight and afterwards from time to time as he    shall be lawfully required.   And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundlandland, shall and do pay and dispose of in a due course of Administration, or in such a manner as the said Court shall direct ; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

To Wit,          } late of St. Johns aforesaid Engineer
deceased, died with out a Will; and that   I    will well and truly administer all and every the Goods of the said deceased and pay his debts so far as his Goods will extend ; and that I    will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of    my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required ; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he    died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the the value of      Fourteen hundred          -------------------- dollars.

The annexed Power of Attorney will require to be Signed and delivered by Mr Brown before a Judge of a Court of Record or before a Mayor or Chief Magistrate , who shall certify his execution of the Same under his Signature and official Seal .
   We have no Judges of Courts of Record, & no mayor or chief magistrate.    In Scotland such documents are always signed before a Justice of the Peace _

I Anne Brown of Colinsburgh in Fifeshire in Scotland ---------
have made ordained constituted and appointed and by these presents do make ordain constitute and appoint David Skirving of Saint John's in   the Is-land of Newfoundland Engineer my true, and lawful Attorney for me in my name and on my behalf to apply to The Honorable the Supreme Court of Newfoundland or one of the Honorable the Judges thereof for Letters Of Administration of the Estate and - Effects in Newfoundland of my son Robert Brown late of Saint Johns afore-said Engineer deceased, and for the purposes of said application and in order to obtain a grant of such Letters of Administration as afore - said to make sign seal and - execute, all such papers documents and writings    as shall be necessary in that    behalf, and generally to act as my Attorney in all mat . ters relating to the application for and obtaining the grant of such Letters of Administration as fully and effectually as if I were personally present , and did the same,    I hereby agreeing to ratify confirm , and allow all and

whatsoever

 

 

whatsoever may be lawfully done or suffered by my said Attorney by virtue hereof
