AFFIDAVIT.
----------------

You shall swear that you believe this to be the last Will and Testament of the Reverend James Browne late of Harbor Main in Northern District of Newfoundland Parish Priest deceased --------

You shall swear the you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of New-foundland, when you shall be lawfully called thereto;     And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Rev James Brown     deceased, and of which        he            died possessed, Do not, according to the best of your knowledge, judgment and belief, amount to the Value of     Two   thousand       ----------- Dollars

So help you God.

I James Brown PP of Tilton Harbor do hereby make and declare my last will and tes_ tament ?i?
1 I bequeath to my sister Twelve Hundred pounds cy for the    e-ducation of her children.
2 I bequeath one hundred pounds cy to the Holy Infancy Society. for the endowment of an altar or for any pious work connected with the Society, by which Twelve masses annually and a per petual remembrance will be sec ured to me. The transmission to be made thro Mifs Johanna D' Alton D ublin if she su??e, if not thro some other of the Secretaries.
3 I bequeath one hundred pounds stng to my Brother Thomas that he may secure a fe?? ma?? annually and a per petual remembrance for the living and dead of the fa mily.

11. I bequeath Fifty pounds cy to Rev ?. F. Howley DD.
12. I bequeath to Rev. In Scott and Rev. P Delaney twenty pounds (cy subscript) each
13 I bequeath to Rev I ? Donnelly Twenty five pounds cy.
14 I bequeath to Wm Brown, Siddawn farm near Inistiogue Co Kilkenny Ten pounds strg.

15 I bequeath the residue to my sister including all my private Property o? Books bunks watches writing dict ?o?se. Coin and whatever stock there may be, also Four N B I have and a Debenture for her own private use.
16 I will leave to her to e rect a suitable monument say an old Irish Granite Cross, in family burial ground, pro bably the selection ?? the ?e??? left to my Brother
17. I sh ? ?ish to have Twenty pounds distributed in charity
18 I hereby appoint my Sister and Rev ? F Howley ?? executors of my will
19 I hereby transfer all my rights title and interest in houses land ?? at Carbonear to my sister

          The Petition of the undersigned _ Eliza Donnelly of Carbonear
          Humbly Sheweth
That Your Petitioner's Brother Rev d James Browne P.P. of Harbor - Main died on the sixteenth day of November last having first made his last Will and Testament
   That the whole of said will, is in the Proper hand-writing of the said Revd James Browne and signed by him.
   That Your Petitioner and to Revd Dr M.F. Howly are the duly appointed Executors to the said Will
   That the said Revd Dr M F. Howly is a deponent is advisedat present without the jurisdiction of this Hon Court
   That at the time of his decease the said Testator was possessed of money And property not exceeding Ten - Thousand Dollars in value
   That no Probate or Administration Has hitherto been granted by the Hon Court.

          Petitioner , therefore prays that Probate of the said Will may be granted

 

granted to her as Executrix on the Said Will named
   And as in duty bound will ever pray

Walsh of Saint John's aforesaid Barrister at - Law maketh oath and saith that he was well acquainted with the late Revd James Browne P.P. of Harbor-Main deceased, that he was well acquainted with the hand-writing of the said deceased. That the Paper-writing hereto annexed marked "A" and purporting to be the last Will and Testament of the said Revd James Browne    is entirely in the hand-writing of the said Rev-d James Browne. That the signature "James Brown P P " appended to the said Will is in to ??? and proper hand-writing of the said Rev. James Browne    And Deponent further saith that at the time of signing of the said Will to said Rev d James Browne was of sound disposing mind memory and understanding to the best of Deponent's knowledge and belief
