The Petition of the Very Reverend John Scott of St John's
Roman Catholic Priest
Humbly Sheweth
That Margaret Blake of St Johns Spinster died
There on the twenty fourth day of June last past
having made and executed her last will and testa-ment as here to annexed and which will has been
duly proved in co?i?io? form. that she died possessed
of property situate within the Jurisdiction of this
honorable Court of the probable value of about Four thousand dollars---------------
That Your petitioner is not aware of any relatives
or next of kin of said deceased resident in this
Colony other than her niece Mary Blake Canning named in the said will_ that in and by her said
last will and testament the said Margaret Blake nominated and appointed your petitioner as
executor thereof. that no probate or administration
of the Estate of the said deceased has been hitherto granted.
Petitioner therefore prays that probate of
the said will may be granted unto him
and as in duty bound he will ever pray
&c &c &c

You shall swear that you believe this to be the true Last Will and Testament of
Margaret Blake late of St. John's in the
Central District, Spinster, deceased
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto : And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said-----
Margaret Blake Deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of
Four thousand two hundred ----------- Dollars.

In the name of God Amen
I Margaret Blake of St. Johns spinster do make
publish and declare this annexed for my last will
and Testament. First I direct that all my just
debts funeral and testamentary expenses shall be
paid .Second . I give devise and bequeath to his
Lordship the Bishop of St Johns the sum of Ten
pounds currency for the use and purposes of the
orphanage at Villa Nova near Topsail . Third
I give devise and bequeath to the Reverend
Superioress of the Convent of S Michael at Belvedere
the sum of Ten pounds currency for the use and
purposes of the ophanage at Belvedere. .Fourth . I
give devise and bequeath to Mary Breen my
servant now residing with me the sum of Fifty
pounds currency. Fifth. I give devise and bequeath
to the Very Reverend John Scott the sum of Ten
pounds for Masses for the repose of my soul---------------
Sixth . I give devise and bequeath to the Venerable Archdeacon Forristal the sum of Ten pounds for
Masses for the repose of my soul. Seventh. I give
devise and bequeath to the Reverend Patrick S.
Delaney the sum of Ten pounds for Masses for the
repose of my soul. Eighth. All the rest residue
and remainder of my property and effects wherever
situate and of what nature or kind so??s the sm??
may be I give devise and bequeath to my niece Mary Blake Canning now residing with me for her
sole use and benefit during her life time and ???
and after her decease I give and devise the s?m
to the Lordship The Bishop of St Johns' for Church
purposes. Ninth. I do hereby nominate and

maketh oath and saith that on the 18th day of June A. D. one thousand eight hundred and eighty seven at St.John's aforesaid he, this Deponent, was present and did see
Margaret Blake late of St John's
Spinster the Testatrix named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper her last Will and Testament, in the presence of this Deponent and of Matthew Flemming the other subscribing witness thereto. That Deponent and said Matthew Flemming ------------ then and there signed their names to such
Will as such witnesses, in the presence of the said Testatrix and of each other
and that at the time of the said execution of the said Will the said Testatrix was
of sound and disposing mind, memory and understanding, to the best of Deponent's
knowledge and belief.

of mortgage executed by her Executor

them to refer the matter in dispute
to the decision of A. J. W. McNeilly Esquire as arbitrator or referee_ both parties
agreeing to abide by any award
he may make therein. The inquiry

Joseph I. Little on f??t of a}
certain mortgage. }
The claims upon this Estate were under
Rule of Court dated the day of referred to me for inquiry and
Report.
Upon this reference I had been attended
By Mr Kent Q.C. for the claim amt
Mortgagee (Mr Justice Little) and
Mr Pitman for the Trustee of the
Insolvent Estate Mr Adams. The
reference had proceeded to a certain
point when the agreement annexed was
entered into between the parties,
dischargeing in effect the reference and
leaving the matters in difference between
the parties to my arbitrament and
award.
Taking all the circumstances of
this case into equitable consideration
I find that there is due to the claimant
under this mortgage a sum of Five
Hundred & Forty Two Dollars & Forty
cents upon payment of which a full release discharge and acquittance
should be given and this I find
subject to the payment by each
party of his own costs upon the
reference which was superceded,
half the master's costs and half
the costs of the arbitration.
