In the Supreme Court

AFFIDAVIT.
------------

You shall swear that you believe this to be the true last Will and Testament of Mary Sage of Saint John's in the Central District of the Island of Newfoundland, Widow.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Mary Sage, deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Five Hundred Dollars.

So help you God.

Notice

After three days from date hereof application will be made to the Supreme Court or one of the Honorable the Judges for Probate of the Will of Mary Sage, late of St. John's, Widow, deceased, to be granted to James Sage of St. John's, Executor named in said will.

The Petition of James Sage of St. John's, Cab Driver

Humbly Sheweth

That your Petitioner's Mother, Mary Sage of St. John's, Widow, departed this life on or about the fifteenth day of July instant having previously made her last Will and Testament which has been duly proved and is hereto annexed and in which your Petitioner has been appointed Sole Executor.
That the said deceased was at the time of her death possessed of property of the probable value of four hundred dollars.
That no probate to said Will or Administration to said Estate has been taken out or applied for.
Your Petitioner prays that Probate be granted to him.
And as in duty bound he will ever pray.

SUPREME COURT OF NEWFOUNDLAND

TO WIT
John Sullivan of Saint John's, Sub. Inspector of Police, maketh oath and saith that on the 17th day of June A.D. one thousand eight hundred and eighty six at Saint John's he, this Deponent, was present and did see Mary Sage late of Saint John's, Widow, the Testatrix named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Thomas J. Smyth of St. John's, Cooper, the other subscribing witness thereto. That Deponent and said Thomas J. Smyth then and there signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

the Island aforesaid, this 26th                              J. Sullivan

A.D. One Thousand Eight Hundred
and Eighty Six.

I, Mary Sage of St. John's, Widow, declare this to be my last Will and Testament.

After the payment of my funeral expenses and all my lawful debts, I will that whatsoever money I may then be possessed of shall be divided into three equal parts and one part of the same be given to each of my three children, James Sage, Charles Sage and Sarah Lewis. I also give and bequeathe to my said daughter Sarah Lewis all my household furniture and effects and all my wearing apparel for her sole use and benefit.

I hereby appoint my said son James Sage to be my Executor.

In witness whereof I have hereunto set my hand this 17th day of June A.D. 1886.

Subscribed by the testator in presence of each of us and at the same time declared by her to be her last Will and Testament.
