In the Supreme Court

AFFIDAVIT.
------------

You shall swear that you believe this to be the true last Will and Testament of Jane Roberts, late of St. John's in the Central District of Newfoundland, Widow, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Jane Roberts, deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Thirteen Hundred Dollars.

So help you God.

Notice

After three days, application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof, for Probate of the Will of Jane Roberts late of Saint John's, widow, deceased, to be granted to Elizabeth J. Winsborrow of Saint John's, wife of William Winsborrow, the Sole Executrix named in said Will.

I certify that the notice on the other side hereof written was posted in my office on the day of the date thereof and has remained there until this day and that no caveat or other objection has been entered thereto.

The Petition of Elizabeth J. Winsborrow of Saint John's, wife of William Winsborrow of Saint John's, Draper

Humbly Sheweth

          That Jane Roberts, late of Saint John's, widow, died there on the twenty fifth day of January last having previously made and executed her last will and testament which is hereto annexed and of which she appointed your petitioner Sole Executrix.
          That said deceased at the time of her death was possessed of property of the probable value of twelve hundred dollars.
          That no probate of any will nor administration of the Estate of said deceased has been granted to any person.
          Petitioner therefore prays that Probate of the will of said deceased may be granted to petitioner
          And as in duty bound she will ever pray &c.
           Dated at Saint John's this fifth day of February A.D. 1886

Elizabeth J. Winsborrow of Saint John's, wife of William Winsborrow, the Petitioner named in the foregoing Petition maketh oath and saith that the several matters and things therein contained and set forth are correct and true.

This is the last Will and Testament of me, Jane Roberts, of Saint John's, widow. I give, devise and bequeath all my interest in the land and dwelling house occupied by me on Gower Street in Saint John's and all the other property, goods, monies and estate of every description of which I shall die possessed to Elizabeth, wife of William Winsborrow of St. John's, Draper, for her absolute use and benefit but upon and subject to the condition that she shall maintain, support and educate my granddaughter Cora Roberts until she shall be able to support herself. I appoint the said Elizabeth J. Winsborrow Sole Executrix of this my Will.
Dated at St. John's this eighteenth day of January A.C. 1886.

TO WIT
Donald Morison of Saint John's, Barrister at Law, maketh oath and saith that on the Eighteenth day of January A.D. one thousand eight hundred and eighty six at Saint John's he, this Deponent was present and did see Jane Roberts, late of Saint John's, widow, the Testatrix named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Amelia Manuel of Saint John's the other subscribing witness thereto. That Deponent and said Amelia Manuel then and there signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other and that at the time of the said execution of the said Will, the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
