B NEWFOUNDLAND AFFIDAVIT You shall swear that you believe this to be the true last Will and Testament of Agnes Ward Pearce, late of Twillingate in the Northern District, Widow, deceased. So help you God. Sarah B. Taylor

NOTICE After three days, application will be made to the Honourable the Supreme Court, or to one of the Honourable the Judges thereof, for Probate of the Will of Agnes Ward Pearce, late of Twillingate in the Northern District, Widow, deceased, to be granted to Sarah Bartlett Taylor of Twillingate aforesaid sole executrix named in said will.
I certify that the notice on the other side hereof written was posted in my office on the day of the date hereof and has remained there until this day and that no caveat or objection has been entered thereto.
To the Honourable the Supreme Court, or one of the Honourable the Judges thereof. The Petition of Sarah Bartlett Taylor of Twillingate Humbly Shewith:- That Agnes Ward Pearce, late of Twillingate aforesaid, Widow, deceased, died there on or about the Tenth day of June A.D. 1885 having previously made and executed her last Will and Testament, which is hereto annexed, of which she appointed your petitioner sole executrix. That said deceased, at the time of her death, was possessed of property of the probable value of Two ___________________(unreadable) dollars. That no Probate of said Will, nor administration of the Estate, of said deceased has been granted to any person. Petitioner therefore prays that Probate of the said Will may be granted to her. And as in duty bound your petitioner will ever pray.

This is the last Will and Testament of me, Agnes Ward, widow of the late Abraham Ackerman Pearce, Clerk of the Court at Twillingate, Notre Dame Bay, Newfoundland. I give, devise and bequeath half of whatever money I have, or may possess. Fig? about Forty pounds Current money of Newfoundland, and the balance due me in the hands of the Executors of my late Husband's Will to my Brother Benjamin Ward of Fair Island (or Fere Island), Greenspond, and the other half of what money I have, or may possess, I give, devise and bequeath to Mary Cook of Twillingate (my niece) for her absolute use and benefit. SUPREME COURT OF NEWFOUNDLAND Northern District Richard Newman of Twillingate aforesaid, Accountant, maketh oath and saith that on the Ninth day of June A.D. One Thousand Eight Hundred and Eighty Five at Twillingate aforesaid, he, this Deponent was present and did see Agnes Pearce late of Twillingate, Widow, the Testator named in the paper writing hereto annexed, duly sign her name - publish and declare the said annexed paper writing as and for her last Will and Testament in the presence of this Deponent and of Robert Temple, Minister, the other subscribing witness thereto. That Deponent and said Robert Temple then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that the said Annexed Will, on paper writing was read over and explained to the said Testator before she signed the same as aforesaid, in the presence of this Deponent and of the said Robert Temple, and that the said Testator clearly understood the same, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
