In the Supreme Court.

AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of William Netten, late of St. John's in the Central District of Newfoundland, Clerk in Holy Orders, deceased. You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Asset, Credits, and Effects of the said William Netten deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of one thousand five hundred Dollars.

So help you God.

The Petition of the Reverend Theophilus George Netten of St. John's, NFLD, Clerk in Holy Orders and John McGowen of the same place, Governor of the Penitentiary,

Humbly sheweth

That the Reverend William Netten, formery (sic) of Catalina NFLD, died at St. John's NFLD on or about the ninth day of January in the present year having first made and executed his last will and testament as hereto annexed, and which will has been duly proved in common form. That so far as your petitioners are aware the said Testator left him surviving three children named respecting Theophilus George Netten, May* Hannah Skelton and Elizabeth Sarah McCowen, all residing in the Colony; That testator died possessed of ????? to the amount of about $1000 (One Thousand Dollars); That in and of his said last will and testament he nominated and appointed your Petitioners as executors thereof; That no probate or administration to the estate of the testator has been heretofore granted. Petitioners therefore pray that probate of the said Will may be granted to them and as in duty bound, they will ever pray &c.

          I, the Revd Theopilus (sic) George Netten of St. John's aforesaid, Church of England Minister, do make oath and say that I am one of the Petitioners in the foregoing petition in this matter named and that the several matters and things in said Petition set forth are just, correct and true.

          Henry Cooke of St. John's aforesaid Manager of the Commercial Bank of Newfoundland, maketh oath and saith that on the First day of August A. D. one thousand eight hundred and eighty three at St. John's aforesaid he, this Deponent, was present and did see Reverend William Netten late of St. John's aforesaid, the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Theodore W. Clift the other subscribing witness thereto. That Deponent and said Theodore W. Clift then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

ST. JOHN'S

          I, William Netten, a native of the Parish of Portsea, England, but for many years a Resident and Missionary at Catalina in Newfoundland, being in an infirm state of health, but, thank God, of sound and disposing mind and understanding, do, for the settling of my temporal affairs, make this my last Will and Testament as follows:
          I commit my soul to my gracious God and Saviour, relying with humble confidence on His atonement and mediation, trusting that He will never leave me, nor forsake me, but that He will ever guide me with His counsel, and afterward receive me to glory. And it is my wish and desire that when I am dead, my funeral may be performed with as little expense as possible, consistent with decency and respect.
          Shortly before I left England in 1832, I effected my Life Assurance with the "Atlas Assurance Company" in London, England, for the sum of £100. sterling. (one hundred pounds sterling) payable within three months after my decease, for which I have paid annually a premium of £3.10.1 sterling (three pounds, ten shillings and one penny sterling) ever since. For further particulars, see my Policy of Life Assurance, together with the Bonus Circulars from the office of the said "Atlas Assurance Company" and sundry communications connected therewith, all of which (or copies thereof) are kept in my Writing Desk. I therefore will and bequeath the said sum of £100. sterling (one hundred Pounds Sterling) as stated in the Policy of my Life Assurance, together with the sum of £67. sterling (sixty seven pounds sterling) stated to be the total addition to the Policy up to Christmas 1874, (see Bonus Circular dated 1st June 1875) and also any additional sum or sums (if any) to the Policy since the said Christmas 1874, to my three children, Elizabeth Sarah McCowen, Mary Hannah Skelton, and Theophilus George Netten, to be divided equally among them, as they are all equally dear to me.
          Also whatever sum of money deposited in the Savings Bank of Saint John's, Newfoundland, on my account, I give and bequeath to my three children afore-named, each of them to have an equal share.
          All this I wish and desire may be done as fairly and equitably as can be, and in accordance with the precept to be {"like-minded, having the same love, being of one accord of one mind."
          And I hereby appoint my Son, Theophilus George Netten, and my Sons-in-law, John Gent Skelton and John Roche McCowen, to be my executors for the purpose of having this my Will performed according to my wishes and intentions.
          Given under my hand this first day of August, in the year of our Lord one thousand eight hundred  and eighty three, at Saint John's, Newfoundland.

          John Gent Skelton of Bonavista in the District aforesaid, Surgeon, maketh oath and saith that I have never intermeddled with the Will of the late William Netten, Clerk in Holy Orders, and that I was not connected with the construction of the same. And I do hereby renounce my title as an Executor of the said Will.
