To Wit       I do swear that I believe that Philip
                  Luscombe
late of ????? aforesaid
                  Labourer -------------------------------------

deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts so far as his Goods will extend; and that I will exhibit a true , full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgement and belief, amount to the the value of Four hundred ----------------------------------------------------- dollars.

The Petition of Eliza Luscombe of St. John's in the Island of Newfoundland Spinster
                  Humbly Sheweth
That Your Petitioner's father Philip Luscombe of St. John's aforesaid Labourer died on the sixth Day of November now last past intestate. That the said Philip Luscombe left him surviving five children, viz. Eliza (Your Petitioner) Mary married to Edward Long, Fanny married to John Rielley, Margaret married to John Walsh and John. That all the said children are resident in St. John's aforesaid with the exception of John who is resident out of the jurisdiction of this Honourable Court. That The said Philip Luscombe died possessed of a leasehold interest in a house at St. John's aforesaid; and that the whole property of the said Philip Luscombe does not to the best of Petitioner's information and belief exceed the Sum of Four Hundred Dollars.
That no Probate or Administration to the Will or Estate of the said Philip Luscombe has been granted or applied for.
Your Petitioner therefore prays that Letters of Administration to the Estate of the said Philip Luscombe deceased be granted to your petitioner.

Be It Remembered, That on this Eighth day of May in the Forty-ninth Year of the Reign of our Sovereign Lady VICTORIA, By the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of our Lord One Thousand Eight Hundred and Eighty-six personally appeared Eliza Luscombe of Saint Johns in the Central District of the Island, Spinster George Luscombe of same place Cooper and Edward Long of same place Porter and did acknowledge themselves to beheld and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Eight hundred Dollars, to be had, made, and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:
NOW THE CONDITION OF THIS OBLIGATION IS SUCH , that if the above bounden Eliza Luscombe as Administratrix of the Estate and Effects of Philip Luscombe late of St. John's aforesaid Labourer deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased which have or shall come to the hands, possession, or knowledge of her the said Eliza Luscombe as such Adminstratrix or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the Eighth day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death or which at any time afterwards shall come to the hands or possession of her the said Eliza Luscombe or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made a just and true account of her said Administration, on or before the Eighth day of May which will be in the Year of our Lord One Thousand Eight Hundred and Eighty-six and afterwards from time to time as she shall be lawfully required. And all the rest, residue and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Notes:

I do not know the relationship of this Philip Luscombe to my other contemporary Luscombe family ties.

At one time I thought that this was the Philip Luscombe married to Ellen Burke but at this time it appears to be not the case as the children appear to be Catholic and an estimate on their DOBs would indicate something circa 1860s. The known children of Philip and Ellen are circa 1840s and 1850s and were all baptised Protestant as are my ties.

A George Luscombe, cooper, was a signatory to parts of the documentation. This may have been George W Luscombe, a cooper, who was a brother to my great great great grandmother Eliza Luscombe who married Richard Atwill. George died in St. John's in 1891. The father of Eliza Luscombe and George W Luscombe was Philip. Eliza and George also had a brother Philip who married Maria Marshall. This brother Philip died 7 November 1885, exactly one day after the Philip in the will. Perhaps this was all coincidence. Perhaps Philip in this will and George were friends or we suspect they were related.

Two children of Margaret Luscombe Walsh have been found baptised at St. Patrick's Church in St. John's in the 1880s.

Three children of Mary Luscombe Long have been found baptised at the Basilica in the 1880s.
