Supreme Court of Newfoundland Be it remembered, That on this Seventeenth day of February in the Forty-ninth Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty six personally appeared the Very Reverend Michael Hanley of Western Bay in Conception Bay Roman Catholic priest and Richard Headen and Timothy Leary both of Small Point Bay de Nord District Planters and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of twenty-three hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:Now the Condition of this Obligation is such, that if the above bounden Very Reverend Michael Hanley as Administrator of the Estate and Effect of Richard Leary late of Low Point Fisherman deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Very Reverend Michael Stanley as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the seventeenth day of August next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the seventeenth day of February which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue. CERTIFICATE I hereby certify that the Notice on the other side hereof written has been posted in my Office from the day of the date thereof to this date and that no Caveat or other objection thereto has been filed or entered. To The Honorable The Supreme Court The Petition of Very Reverend Michael Hanley of Western Bay in Conception Bay Roman Catholic Priest Humbly Showeth That Richard Leary formerly of Low Point in Conception Bay aforesaid fisherman was drowned at sea in the spring of this present year. That he died intestate and possessed of property situate within the jurisdiction of this honorable Court of the probable value of about eleven hundred and fifty five dollars and sixty six cents being money deposited in the Newfoundland Savings Bank. That he left him surviving his Mother Mrs Johana Leary now a resident at Low Point aforesaid and very old and feeble also one brother Timothy also resident at Low Point aforesaid and a sister named Susana Leary now the wife of John Dunn XXXXX of St John's Fisherman. That the father of the said intestate died several years before him. That the mother of the said intestate has assented to the grant of administration to his estate being made to your petitioner as appears by the written consent hereto annexed and marked A. That no probate or administration to the estate of the said deceased has been hitherto granted. Petitioner therefore prays that administration of the estate of the said Richard Leary deceased may be granted now to him and ??? is duty bound he will ever pray ?? A I, the undersigned Mrs. Johana Leary of Low Point in Conception Bay, Widow, the mother of Richard Leary of same place, fisherman, who was drowned at sea in the spring of this present year, do hereby consent and agree that administration taken to his estate be granted to the Very Reverend Michael Hanley of Western Bay in Conception Bay, Roman Catholic Priest. Witness the same having been first read Supreme Court In the matter of the estate of I, Richard Headen of Small Point do make oath and say that I was present and saw Joannah Leary, the party named in the the above written consent in this matter, duly sign the same by offering her mark thereto.
